Publish Presidential Decree 13/2025, Prabowo Inaugurates Regional Head February 20, 2025

JAKARTA - President Prabowo Subianto has determined the latest reference used to inaugurate regional heads by signing Presidential Regulation (Perpres) Number 13 of 2025.

In a copy document obtained from the Legal Documentation and Information Network of the Ministry of State Secretariat which was confiscated by Antara, Friday, February 14, Presidential Regulation number 14 of 2025 is about the Second Amendment to Presidential Regulation number 16 of 2016 concerning Procedures for Inauguration of Governors and Deputy Governors, Regents and Deputy Regents, as well as Mayors and Deputy Mayors.

This regulation only has two articles, but in it there are changes and additions of new articles that are useful for improving and completing information according to current conditions.

In the regulation, the new article includes Article 6A and Article 22B, then changes occur in several articles consisting of Article 7 and Article 22A.

In Article 6A it is stated that the president as the holder of government power can simultaneously inaugurate regional heads in the nation's capital.

When the inauguration takes place, the chairman or deputy chairman of the regional people's representative council must be present to witness the inauguration process.

Discussing changes in Article 7, there are additional oaths or promises of office according to the religion held for regional heads who have Confucian religious beliefs.

The regional head who adheres to the Confucian religion in this provision must say "To the presence of Tian in a place that is Highest with the spiritual guidance of the Prophet Kong Zi, seeded, I swear".

Furthermore, dissecting changes to Article 22A, now in the latest provisions approved by President Prabowo, there is an information update that the inauguration of regional heads is carried out in accordance with the results of the simultaneous regional head and deputy regional head elections in 2024 and takes place on February 20, 2025.

This provision also regulates that simultaneous inauguration of regional heads can be held for results that do not have cases of dispute over the 2024 Simultaneous Regional Head Elections at the Constitutional Court and on results that are not continued at the next trial as stated in the results of the Constitutional Court's decision on February 4 and 5, 2025.

The inauguration of regional heads can be carried out through February 20, 2025 if three things occur, namely the dispute over the results of the Pilkada in the Constitutional Court which is decided on the subject of the application or the final decision; the dispute over the results of the 2024 Pilkada in the Constitutional Court has been decided to carry out the re-election; or related to force majeure.

Finally, there is Article 22B, as a new article containing provisions related to the inauguration and taking of the oath of office in Aceh.

The provision stipulates that the governor and deputy governor are sworn in by the Minister of Home Affairs on behalf of the President of the Republic of Indonesia before the Chief Justice of the Aceh Syar'iyah Court at the plenary meeting of the Aceh People's Representative Council.

Meanwhile, regents and deputy regents as well as mayors and deputy mayors were sworn in by the governor on behalf of the President of the Republic of Indonesia before the Chairman of the Aceh Syar'iyah Court in a plenary meeting of the Regency/City Representative Council.

President Prabowo appointed Presidential Decree 13 of 2025 in Jakarta on February 11, 2025 and promulgated on the same day.
