KPK Leaders Call The Dismissal Of Officials Should Be Carried Out By The President Based On The Law

Deputy Chairman of the Corruption Eradication Commission (KPK) Johanis Tanak said state officials should only be dismissed by the president. This process is in accordance with state administrative law.

This was conveyed by Johanis in response to the new rules in the DPR RI which could be an excuse to dismiss the KPK leadership to constitutional judges and Supreme Court justices.

"Yes, that's right (only the president can take the removal, ed)," Johanis said when contacted by reporters, Thursday, February 5.

In the context of the head of the anti-corruption commission, for example, Johanis said that dismissal by the president must still refer to Law Number 19 of 2019. This regulation must be obeyed or later decisions will be vulnerable to being sued or tested at the Supreme Court (MA).

"The DPR regulations are under the law so that if there are parties who feel their interests are harmed by the DPR RI regulations, they can submit a judicial review application to the Supreme Court," he said.

Previously reported, the DPR RI ratified the revision of DPR RI Regulation Number 1 of 2020 concerning Order (Tatib). The amendment regulates the parliamentary authority to evaluate state officials stipulated in the fit and proper test.

The decision was approved at the 12th Plenary Meeting of the DPR RI Session Period II for the 2024-2025 Session Year at the Parliament Complex, Senayan, Jakarta, Tuesday, February 4.

Deputy Chairperson of the Legislation Body (Baleg) of the DPR, Sturman Panjaitan, conveyed the points of changing the DPR's Rules, namely adding one article 228. In paragraph (1), regulating state officials stipulated in the DPR plenary meeting can be evaluated regularly.

"In order to improve the supervisory function and maintain the honor of the DPR on the results of the commission discussion as referred to in article 227 paragraph (2) the DPR can conduct periodic evaluations of candidates that have been determined in the DPR plenary meeting," said Sturman.

Then, in paragraph (2), regulating the results of the evaluation is binding and submitted by the commission to the leadership of the DPR to be followed up according to the mechanism.

"The results of the evaluation as referred to in paragraph (1) are binding and submitted by the commission which evaluates the leadership of the DPR to be followed up according to the applicable mechanism," said Sturman.
