Petamburan Residents Report Anies To The Ombudsman For Not Fulfilling Promises Of Compensation For Evictions Of Rp4.73 Billion
JAKARTA - Representatives of residents of Petamburan Flats reported DKI Jakarta Governor Anies Baswedan to the Greater Jakarta Ombudsman Representative for suspected maladministration.
LBH Jakarta's Public Lawyer who accompanied the Petamburan residents, Charlie Albajili, said residents reported Anies for not complying with the court's decision ordering Anies to pay compensation to 473 residents affected by the evictions amounting to Rp4.73 billion.
"The court's decision, which is legally binding, orders the DKI Provincial Government to pay compensation to 473 families of Petamburan residents in the amount of Rp4,730,000,000 and provide flats according to the promise before the eviction," Charlie said in his statement, Thursday, October 28.
This case began when 473 families of RW 09 Petamburan sub-district, Central Jakarta were evicted in 1997 for the construction of a simple-owned flat (rusunami).
Unfortunately, at that time the DKI Provincial Government carried out unilateral land acquisition and the construction of flats was delayed. The residents then sued the DKI Provincial Government to the Central Jakarta District Court and won the lawsuit on December 10, 2003.

The decision of the Central Jakarta District Court was upheld by the decision of the DKI High Court on December 23, 2004 and the decision of the Supreme Court (MA) on June 26, 2006. However, the DKI Provincial Government made a review which was later rejected through Supreme Court Decision Number 700/PK.pdt/2014.
"The provincial government also applied for a non-executable status to the Chairman of the Central Jakarta District Court, but it was again rejected," said Charlie.
Until finally, Anies had promised to comply with the Supreme Court's decision and paid compensation of Rp4.73 billion to residents on January 15, 2019. However, until now Anies has never kept his promise.
“There is no reason why the provincial government does not execute the decision and restore the rights of the citizens. What the DKI Provincial Government has done is maladministration and violates the rights of residents to get reparation for violations of the guarantee of adequate housing that have been experienced," said Charlie.
During the meeting, the Chairperson of the Indonesian Ombudsman Representative for Greater Jakarta promised to follow up on the complaint based on the authority in Law Number 37 of 2008.
