12 Candidates For Supreme Court Justices Rejected By DPR, KY Affirms Selection Process According To Procedures

The Judicial Commission emphasized that the selection of candidates for Supreme Court justices and prospective judges at the Supreme Court in 2024 was in accordance with applicable procedures and regulations.

The Judicial Commission (KY) has denied the assumption that Commission III of the DPR stated that there was an error in the selection mechanism for prospective judges because it still passed two candidates for Supreme Court Justices of the Special Tax Administration (TUN) who did not meet the requirements.

"Commission III of the DPR RI has provided statements through the media so that KY needs to feel the need to straighten out the perception of violations of the rules in the selection of candidates for Supreme Court justices and prospective judges in the Supreme Court," said KY Spokesperson Mukti Fajar Nur Dewata as reported by ANTARA, Thursday, August 29.

Mukti explained that the two candidates for Supreme Court justices of the Special Taxation TUN Chamber who did not meet the requirements were the plenary decision to exercise discretion or relaxation of requirements based on Article 22 of Law Number 30 of 2014 concerning Government Administration.

Normatively, he added, tax judges are a career judge path who has had the experience of being a judge for at least 20 years, as regulated by Law Number 3 of 2009 concerning the Supreme Court.

However, a tax court was only established in 2002. Under Law Number 14 of 2002 concerning the Tax Court, the minimum age requirement for tax judges is 45 years.

"Thus, there is no experienced tax judge 20 years as a judge. According to KY data, the most senior judge in the Tax Court only has 15 years of experience as a judge," said Mukti.

In addition, the Supreme Court's need for special TUN judges is also very urgent. The number of cases stands at more than 7,000, while the Supreme Court currently only has one Special Tax TUN judge.

"Registrants for candidates for Supreme Court justices of the Special Taxation Room are limited so that discretion is needed to meet the needs of the Supreme Court," said Mukti.

According to KY, the same issue has also occurred in the selection of candidates for Supreme Court justices in the previous period, namely the appointment of four military Supreme Court justices who have not met the requirements for 20 years of experience.

Previously, Commission III of the DPR on Wednesday (28/8), agreed not to give approval to the 12 candidates for Supreme Court justices and judges at the 2024 Supreme Court submitted by KY to the DPR RI for a fit and proper test.

This was decided after all factions in Commission III of the DPR RI expressed their views on the error in the selection mechanism for candidates for Supreme Court justices and Hakimads so that they passed candidates who did not meet the requirements.

According to Commission III of the DPR, there are two candidates for Supreme Court justices in the Special Taxation TUN Chamber who do not meet the requirements of Article 7 of the Supreme Court Law, namely Hari Soh Advianto with eight years of experience as a judge and Tri Hidayat Wahyudi with a 14-year experience as a judge.
