Prosecutors Demand 7.5 Years In Prison Corruption Defendant At The Pratama Hospital, Aru Maluku Islands

The prosecutor demanded that the defendant RAR be sentenced to 7.6 years in prison in the corruption case of the budget for the construction of the Pratama MARliasa Hospital project, Aru Islands Regency, Maluku Province.

The Public Prosecutor (JPU) of the Aru Islands District Attorney (Kejari) Nicholas Simanjuntak said that the defendant RAR was guilty of violating Article 2 Paragraph (1) of Law Number 20 of 2001 concerning amendments to Law Number 31 of 1999 concerning the eradication of corruption in conjunction with Article 55 paragraph (1) 1st of the Criminal Code in conjunction with Article 65 of the Criminal Code.

"The defendant was also sentenced to pay a fine of Rp. 300 million, subsidiary to three months in prison but was not charged with paying compensation," Nicholas said in a virtual appeal at the Corruption Court at the Ambon District Court Office, Monday, July 8, which was confiscated by Antara.

Nicohlas said the aggravating thing for the defendant was not supporting the government's program in eradicating corruption. While the mitigating thing is that the defendant is polite and has never been convicted.

According to the Public Prosecutor, in the 2017 fiscal year, the Aru Islands Regency Government through the Special Allocation Fund (DAK) for Health has allocated a budget for the construction of the Marlasi Primary Hospital in the amount of Rp. 18,518,518,525.

The amount of this budget is stated in the document for the implementation of the Budget Change (DPPA) of the SKPD of the Indonesian Archipelago Health Office for the 2017 Fiscal Year.

However, in determining the provider for the work of the Pratama Hospital in question, the defendant RAR as the Commitment Making Officer (PPK) for construction work at the Aru Islands Health Office sent a letter requesting an auction for physical development packages to the local district government's Procurement Service Unit (ULP).

The letter numbered: 602.1/545.a/2017 to conduct an auction of work packages for the construction of the Pratama Marlasi Hospital for the 2017 Fiscal Year with a budget ceiling value of Rp. 18,518,518,525 and an estimated price (HPS) of Rp. 18,518,500,000.

"The state financial losses arising in this case amounted to Rp1.8 billion," said Public Prosecutor Nicholas.

After listening to the prosecutor's demands, the panel of judges postponed the trial until next week with the agenda of hearing the defendant RAR's defense through his legal adviser, Rolentio Lololuan.
