Yusril Calls The Ministers Of The National Police Presented To The Constitutional Court Session Can't Be Evidence Of Presidential Election Dispute

JAKARTA - The head of the Prabowo-Gibran legal team, Yusril Ihza Mahendra, invited the Ganjar-Mahfud team to ask the Constitutional Court (MK) to present the National Police Chief General Listyo Sigit to provide information in the 2024 presidential election dispute trial.

This was conveyed by Yusril on the sidelines of the trial of dispute over the results of the general election (PHPU) which was scheduled to read information from experts and witnesses of the applicant, in this case the Ganjar-Mahfud camp.

"We ourselves have no interest in presenting the National Police Chief. But because the National Police Chief is an institutional position, because of that his presence cannot be requested, presented by us as well as the applicant's attorney and attorney, but it must be presented by the Constitutional Court," said Yusril at the Constitutional Court building, Tuesday, April 2.

Yusril also admitted that there was no problem with the Constitutional Court planning to summon President Joko Widodo's ministers to attend the trial.

However, according to Yusril, statements from the minister and the National Police Chief, if they are to be presented to the Constitutional Court, cannot be used as evidence. This is because witnesses or experts who can strengthen the applicant's lawsuit as evidence must be sworn in first.

"If the National Police Chief and the minister are presented, the Constitutional Court is summoned, it is a statement and is not sworn in. The position is different. If it is sworn in, the statement becomes evidence," said Yusril.

"But if the giver of the statement may be a kind of ad memorandum of informants. He provided information or information whether the judge, the judge could not be used as evidence, but provided information to the judge to understand the context of this issue," he added.

For information, Chief Justice of the Constitutional Court Suhartoyo said that the panel of judges banned four ministers of President Joko Widodo or Jokowi to be heard in his statement during the 2024 presidential election dispute trial.

They include Coordinating Minister for Human Development and Culture (Menko PMK) Muhadjir Effendy; Coordinating Minister for Economic Affairs Airlangga Hartarto, Minister of Finance (Menkeu) Sri Mulyani; and Minister of Social Affairs (Mensos) Tri Rismaharini.

Not only that, the court also agreed to present the Honorary Council of Election Organizers (DKPP). However, it is emphasized that their summons does not mean that the court accommodates the applicants. However, it is only for the benefit of the trial.

"This is solely for the benefit of the judges. In simple language, we reject the petitioners' petition, but we take a separate stance because the positions of the judges choosing these parties are seen as important to hear at trial," Suhartoyo explained.

Today, the legal team Ganjar-Mahfud asked the Constitutional Court to present the National Police Chief General Listyo Sigit Prabowo to hear his statement at the trial. The application letter has also been sent.

"Look, we have sent a letter to the Constitutional Court, that in addition to the 4 ministers who will be presented plus DKPP, we will also ask the Chairman of the Assembly to present the Chief of Police at the next trial. We have written a letter for that," said the Head of the Ganjar-Mahfud Legal Team, Todung Mulya Lubis, to reporters, Tuesday, April 2.

According to Tudong, if the National Police Chief can be presented at the trial, what will be explored from the police general is about allegations of intimidation to the neutrality of police officers in the 2024 General Election.

"Why the police chief? Because later it will be shown that there are quite a lot of things related to the police, the police who carry out intimidation, criminalization, who are involved with neutrality in the campaign," he said.
