Short-Term Program For PWI Journalists Defense, Building LKBPH

JAKARTA - The Chairman of the Defense of Journalists and Advocacy of the Central PWI, together with his team, is running a short-term program aimed at building a Legal Aid and Enforcement Consultation Institute (LKBPH) as a service and protection for PWI members.

Even though PWI already has legal aid institutions in various regions, there is a need to align it with Law no. 16 of 2011 concerning Legal Aid Institutions (LBH).

The first meeting of the Central PWI Journalists Advocacy Team was attended by Chairman Kamsul Hasan, Deputy Chairperson of Naek Pangaribuan, and Chelsea Secretary.

Their first step is to prepare a legal entity in accordance with Law no. 16 of 2011 concerning LBH, which will be domiciled in DKI Jakarta and networked with LKBPH in various provinces, districts, and cities.

This LKBPH will focus on providing legal services related to disputes in press reports and or violence against journalists. Priority is PWI members, but this service is not closed to non-members as long as the citizenship identity is clear.

The team is also studying Permenkumham No. 3 of 2011 concerning Paralegal to understand what a paralegal is and how to become a legalist who has competence through Recognition training.

As a legal entity, LKBPH is also required to have NIB with KBLI 6901 which includes various activities related to lawyers/law advisors, legal aid institutions, and other legal services.

After administrative preparation is met, the recruitment of the Paralegal will be carried out, followed by Recognition training to obtain competency recognition from the National Legal Development Agency (BPHN).

The requirements for those who want to become LKBPH members include adults, Indonesian citizens, interested in the world of advocacy, and willing to provide free services.

The Central PWI Journalists and Advocacy Defense Team, Kamsul Hasan, said his team would also collect data with the help of provincial, district and city administrators regarding disputes in press reports and violence against journalists.

LKBPH will make an inventory:1. Whether the management of provincial and district/city PWI already has LBH.2. If you already have LBH, whether you are already a legal entity according to Law no. 16 of 2011 concerning LBH.3. How many advocates already have BAS.4. Do you already have a paralegal according to Permenkumham No. 3 of 2021 concerning Paralegal.5. Whether the Paralegal already has the competence of BPHN or not.

Regarding the form of a legal entity, there are two options, namely the foundation in accordance with Law no. 28 of 2004 or the association refers to Staatsblad 1870 No. 64 regarding associations of legal entities according to the direction of the Directorate General of AHU.
