ASN Sanctions Participate In Election Campaign, Abdi Negara Must Know!
YOGYAKARTA Indonesia will hold a simultaneous general election (election) on February 14, 2024. In order to maintain neutrality, the State Civil Apparatus (ASN) and the TNI, and are prohibited from participating in the election campaign. So, what are ASN sanctions participating in the election campaign?
It should be noted that the ban on participating in the election campaign also applies to village heads, village officials, and/or members of village deliberative bodies.
If these rules are violated, ASN, TNI, Polri or village officials can be subject to imprisonment and a fine of tens of millions of rupiah.
This provision is contained in Article 494 of Law Number 7 of 2017 concerning Elections.
The following reads:
Every state civil servant, member of the Indonesian National Army and the Indonesian National Police, village head, village apparatus, and / or member of the village treatment agency who violates the prohibition as referred to in Article 280 paragraph (3) shall be punished with a maximum imprisonment of 1 (one) year and a maximum fine of Rp12,000,000.00 (twelve million rupiah).
In addition to state civil servants, the TNI, Polri and village officials, there are a number of state officials who are prohibited from being involved in election campaigns.
Based on Article 280 paragraph (2), here are a number of parties who are prohibited from participating in the election campaign:
Based on Article 493 of the Election Law, the implementer of the campaign team involving these parties in the campaign team can be subject to a maximum imprisonment of 1 (one) year and a maximum fine of IDR 12,000,000.
Meanwhile, officials who participate in the election campaign team can be subject to a maximum imprisonment of 2 years and a maximum fine of Rp. 24,000,000. As stated in Article 522 of the Election Law.
Every chairman/deputy chairman/chairman/presidential chief/chief of the constitution, judges at all judicial bodies, chairmen/deputy chairmen and/or members of the Supreme Audit Agency, governors, Senior Deputy Governors, and/or deputy governors of Bank Indonesia as well as directors, commissioners, supervisory boards, and/or employees of state-owned enterprises/regional-owned enterprises who violate as referred to in Article 280 paragraph 93) shall be sentenced to a maximum imprisonment of 2 (two) years and a maximum fine of Rp. 24,000,000 (twenty-four million rupiah).
