IDR 3.6 Billion Corruption, Director of a Regional Company in South Sumatra Sued for 8 Years in Prison
PALEMBANG - The accused, former Main Director of the Regional Company (PD) Hotel Swarna Dwipa, South Sumatra (Sumsel) Augie Bunyamin is being prosecuted for eight years in prison for alleged corruption of IDR 3.6 billion for the construction of infrastructure facilities for Sport Hotel Injuries and Therapy for the 2017 fiscal year.
The demands were conveyed by the South Sumatra High Prosecutor's Office during a trial at the Corruption Crime Court at the Palembang District Court chaired by judge Sahlan Effendi, in Palembang, Tuesday.
"We hereby demand that the panel of judges who tried this case sentenced the first defendant (Augie) to eight years in prison and a fine of IDR 300 million, a subsidiary of six months in prison", said South Sumatra Public Prosecutor, Iskandar, quoted by ANTARA, Tuesday, January 31
According to the prosecutor, based on the adequacy of evidence and witness testimony during the trial, the defendant Augie was proven guilty legally and convincingly of committing an unlawful act, abusing his authority and enriching other people.
As for the other person referred to by the prosecutor, namely the second defendant Ahmad Tohir as the Attorney of PT Palcon Indonesia-PT Sayopi Karyatama KSO the contractor for the construction of infrastructure facilities for Sport Hotel Injuries and Therapy at PD Perhotelan Swarna Dwipa South Sumatra, in Palembang.
During the trial, the prosecutor demanded that the prosecutor Tohir be sentenced to eight years in prison and fined IDR 300 million, a subsidiary of six months in prison. Then, they were also subject to additional punishment in the form of payment of compensation of IDR 3.615 billion.
The provisions apply to the payment of replacement money if the defendant does not pay within a maximum period of one month after the decision of the inrah, then his property will be confiscated for auction, or a prison sentence of four years will be replaced.
The defendants Augie and Tohir were charged with violating Article 2 paragraph (1), in conjunction with Article 18 of Law Number 31 of 1999 concerning the Eradication of Corruption Crimes, as amended by Law Number 20 of 2001 in conjunction with Article 55 paragraph 1 1 of the Criminal Code in the primary indictment.
Previously, based on the prosecutor's indictment, it was known that around 2016-2017, Augie Bunyamin as the Main Director of PD Perhotelan Swarna Dwipa carried out the rehabilitation of hotel construction using funds from a budget ceiling of IDR 37 billion.
The implementation of the construction was then given to the contractor, namely PT Palcon Indonesia, whose leadership power was held by Ahmad Tohir.
From the results of the prosecutor's investigation of several witnesses and experts, it was found that the volume of buildings being rehabilitated only reached 42 per cent.
The expert team from BPKP of South Sumatra Province also noted that the lack of building volume resulted in state losses of IDR 3.615 billion, and at the same time found that the appointment of PT Palcon Indonesia as a contractor allegedly went through an auction process, or was not by the BUMD regulations in force at that time.

Judge Sahlan Effendi closed the trial by reading the charges. The trial will continue on Tuesday, February 7 next week, with the agenda of reading pledoi from the two defendants accompanied by their respective legal advisers at the Palembang Tipikor Court.
