Ferdy Sambo Cs Not Attending Appeal Decision Session

The defendant Ferdy Sambo Cs was not present at the trial of the appeal decision of the alleged premeditated murder of Yosua alias Brigadier J at the DKI Jakarta High Court (PT) today.

The absence of Ferdy Sambo Cs was because the patient chair in the courtroom seemed empty. Usually, the defendant fills the chair in a case.

It turned out that the defendant's presence at the appeal hearing at the High Court level was not mandatory.

Jakarta High Court Public Relations Officer (PT) Binsar Pakpahan said that it was not mandatory for the defendant to be present at the appeal level to comply with the law.

"In accordance with the provisions of the procedural law in the form of laws, we are not required, the High Court is not required to present the parties," Binsar said when confirmed, Wednesday, April 12.

At least, there are two reasons why the DKI Jakarta High Court is also not obliged to summon the parties to attend the appeal trial. First, the absence of a bailiff.

Then, another reason because the presence of the defendants who filed an appeal was detrimental. Because, they will immediately know the Bandung decision.

In fact, the rules for the parties involved have 14 days to take further legal steps after knowing the contents of the verdict.

"Even if he is present, he asks to be determined to be present, in fact he himself is the one who is harmed," said Binsar.

Meanwhile, the defendants who filed an appeal in the alleged murder case of Yosua alias Brigadier J included Ferdy Sambo, Putri Candrawathi, Bripka Ricky Rizal, and Strong Ma'ruf.

In the first instance trial, Ferdy Sambo, the mastermind of the murder of Brigadier Yosua Hutabarat was sentenced to death, Putri Candrawathi was sentenced to 20 years in prison, while Strong Ma'ruf and Ricky Rizal Wibowo were each sentenced to 15 years and 13 years in prison.

Quoted from the criminal appeal case data on behalf of Ferdy Sambo et al, there are five high judges who will read out the appeal decision.

They are Singgih Judge Budi Prakoso as chairman of the assembly in the Ferdy Sambo case and become member judges in other cases, and Judge Ewit Soetriadi who became chairman of the assembly in the Putri Candrawathi case and became member judge in other cases.

Furthermore, there was Judge H. Mulyanto as chairman of the assembly for the Ricky Rizal Wibowo case and became a member judge in another case, Judge Abdul Fattah who became chairman of the panel for the Strong Ma'ruf case and became a member judge in another case, as well as Judge Tony Pribadi as member judge.
