Judge Regarding The Amount Of Replacement Money Only Rp900 Million: Helena Lim Not Enjoying

The panel of judges did not grant the demands of the public prosecutor (JPU) regarding the amount of replacement money that the defendant Helena Lim had to pay worth Rp. 210 billion. The reason is that the crazy rich Pantai Indah Kapuk (PIK) did not enjoy Harvey Moeis' 'security' money.

"The panel of judges does not agree with the criminal charges of the public prosecutor regarding the proportional charge of replacement money against the defendant Helena for security funds that seem to be CSR funds worth 30 million US Dollars or equivalent to 420 billion rupiah at an exchange rate of Rp. 14,000," said Hakim in a trial at the Jakarta Corruption Court, Monday, December 30.

Based on legal facts revealed at the trial, Harvey Moeis in his testimony stated that he had received all the money from the defendant Helena.

The money is a security fund as if the CSR funds that Harvey Moeis received from the smelter companies. Then, transferred to PT Quantum's account.

"The panel of judges is of the opinion that Helena does not enjoy security money or as if the CSR funds," said the judge.

"Punishing the defendant helena to pay compensation in the amount of Rp. 900 million no later than 1 month after this decision has permanent legal force," said the judge during a trial at the Jakarta Corruption Court, Monday, December 30.

In the procurement of the replacement money with the condition that if Helena is unable to pay the replacement money, then, the difference in assets is confiscated for auction.

"If you don't pay, your property will be confiscated and auctioned off by the prosecutor to cover the replacement money provided that if the convict does not have sufficient property, he will be sentenced to imprisonment for 1 year," said the judge.

Meanwhile, the amount of replacement money given by the judge was lower than the demands of the public prosecutor (JPU). Previously, the prosecutor asked Helena to pay compensation of Rp210 billion.

Helena Lim was found guilty in a tin corruption case and sentenced to five years in prison.

Not only imprisonment, Crazy Rich Pantai Indah Kapuk (PIK) as well as the owner of the PT Quantum Skyline Exchange was also sentenced to a fine of Rp. 750 million.

If the defendant cannot pay the fine, he will be replaced with imprisonment for 6 months.
