Wednesday Afternoon, The Court Holds A Lawsuit On The Age Requirements For Presidential And Vice Presidential Candidates Again

JAKARTA - The Constitutional Court (MK) has scheduled to re-trial a lawsuit regarding the minimum age limit for presidential and vice presidential candidates (cawapres) on Wednesday, November 8 at 13.30 WIB.

The lawsuit with registration number 141/PUU-XXI/2023 was filed by a student at the Faculty of Law, Nahdlatul Ulama Indonesia University (Unusia), Brahma Aryana (23).

The material in the lawsuit is related to the Constitutional Court's decision which states that the presidential and vice-presidential candidates are at least 40 years old or have been / are currently in the position chosen through the general election (election).

"The judicial review of Law Number 7 of 2017 concerning General Elections. Agenda for the preliminary examination trial I," wrote the trial schedule on the MK website quoted by VOI.ID, Wednesday, November 8.

Chairman of the Honorary Council of the Constitutional Court (MKMK) Jimly Asshiddiqie said that Unusia students are testing laws that have undergone changes due to the Constitutional Court's decision. According to him, this step can be taken.

"At the time of the trial, the applicants may use the provisions of Article 17 father (1) of the Basic Law on Judicial Power Number 48 of 2009, namely the right of inkar related to the Constitutional Court's decision, namely the reported judge who has been given the sanction may not follow the handling of the case. This means that there are only four judges, so there is an opportunity for change, but not by the Constitutional Court, but by the Constitutional Court itself," explained Jimly.

However, Jimly insists that the 'game' is already running.

"The rules of the game, if for example are changed through the Constitutional Court's decision, apply to the next match in 2029. Now the match is running, and this needs to be conveyed so that there is certainty," said Jimly.
