Projo: The Constitutional Court's Decision Is Already On Implementation Due To The Final And Binding

Chairman of the Presidential Election Winning Body (Bappilpres) Projo Panel Barus said the decision of the Constitutional Court (MK) related to the requirements for the age of the presidential/cawapres candidate was at the level of implementation because it was final and binding, so there was no need to argue anymore.

"The Constitutional Court's decision is final and binding. The final means that there are no further legal remedies, such as appeals, and binding, meaning that it must be implemented," said Panel Barus as quoted by ANTARA, Monday, November 6.

According to him, the debate and public discussion regarding the presidential/cawapres age limit were carried out before the Constitutional Court's decision was produced.

However, he said, what is happening now is the political efforts of a number of actors to influence the determination of the presidential/vice-presidential candidate pair by delegitizing the decisions and the Constitutional Court itself.

"In fact, delegitimation has also targeted, among others, the presidential, KPU, and Bawaslu institutions," he said.

Panel Barus menilai mempertanyakan para hakim MK dan penguyangan hak angket di DPR tidak akan mengubah putusan MK terhadap Perkara Nomor 90/PUU-XXI/2023.

"This is what the public must know and understand. Do not consider this maneuver capable of blocking Mas Gibran from becoming a vice presidential candidate," he said.

Therefore, he asked all parties to relax Gibran Rakabuming Raka to compete in the 2024 presidential election, and see the problem clearly so that it does not drag on into delegitimation of state institutions.

On the other hand, he said, the public must now start to see presidential/cawapres candidates in terms of their programs and work in the community.

"Changing the name of the Constitutional Court as a 'Family Court' and dragging President Jokowi into the Constitutional Court's decision is a dangerous form of delegitimation," he said.

According to him, all candidates want to win in the 2024 presidential election. However, Panel Barus reminded them not to justify any means to achieve it.

"Don't justify any means, among others,, to hinder the nomination of other figures by delegitizing state institutions that will divide national unity," he said.
