Recidivist Of The Rudapaksa Case Of Minors In Ambon Sentenced To 12 Years In Prison With Similar Cases

AMBON - The panel of judges at the Ambon District Court, Maluku, sentenced Imsar Wally, a recidivist who has returned to being a defendant in a case of forced and child intercourse. "Declaring that the defendant is legally and convincingly proven guilty of violating Article 81 paragraph (1) of Law Number 17 of 2016 concerning the Determination of Perppu Number 1 of 2016 concerning the Second Amendment to Law Number 32 of 2002 concerning Child Protection," said Ambon District Court Chief Justice Haris Tewa when reading the verdict in Ambon, Antara, Wednesday, August 23. In its ruling, the panel of judges also sentenced the defendant to pay a fine of Rp160 million, subsidiary to three months in prison. Establishing the detention period that the defendant has served is deducted entirely from the prison sentence imposed and stipulates that the defendant remains detained and pays a court fee of Rp2,000. The aggravating thing was that the defendant was sentenced to prison and paid a fine because he was a recidivist and his actions continued using threats against the victim who was still a minor. "Meanwhile, the mitigating thing is that the defendant is polite and admits his actions," said the judge. The judge's decision is the same as that of the Public Prosecutor's Office of Ambon Senia Pentury, who demanded that the defendant be found guilty and sentenced to 12 years in prison.

Previously, the defendant Imsar Wally was reported on suspicion of sexual intercourse with minors in the same way four times. In fact, since 2022, the defendant has only finished serving a prison sentence of seven years because a similar case with the victim is also a minor.
