Smuggling Of More Than 4 Tons Of Pain And Fattening Drugs To Uzbekistan Has Been Thwarted

TANGERANG - The Main Service Office of Customs and Excise Type Customs (KPUBC TMP) C Soekarno-Hatta (Soetta), Tangerang together with the Food and Drug Supervision Agency (BPOM) succeeded in preventing efforts to smuggle 430 cartons of illegal drugs or 4.865 tons aimed at Uzbekistan. These illegal drugs are planned to be sent by air. "After receiving the information, the officers then conducted research. And Alhamdulillah, before the goods were dispatched to the plane, they could be prevented immediately," he said at a press conference in Tangerang, Antara, Wednesday, August 9. From the findings of efforts to smuggle 430 cartons of traditional medicine (OT) containing medicinal chemicals (BKO), it is known that they do not have a distribution permit (TIE), and the estimated value of the goods is approximately IDR 4 billion. "Each of them reached 430 cartons with a value of this preventive item reaching Rp4.1 billion, which was planned to be exported," he said. Based on the results of his friend, the Customs and Excise investigator team secured one suspect who acted as the sender of the evidence. "And there are four types of illegal drug commodities, including Montalin, Wild Tawon, Gingseng Kianpi Pil and Samyunwan, domestically produced," he said. Customs and Excise has coordinated with BPOM to follow up in accordance with the applicable legal process. Evidence of drugs without a distribution permit was handed over and has now been secured at BPOM RI. Traditional medicinal products contain chemical drugs with a total weight of more than four tons, with details of 200 cartons, 100 Pcs, 50 Illegal Tawons, 200 Pcs, 30 Kartons of Gingseng Pills, 48 Pcs, and 150 Kartons of Samyunwan, 30 Pcs. "This product is claimed to be a nutrition supplement with the purpose of exporting Uzbekistan and will be used as a pain reliever, aches, and a fatter. The perpetrator is known to have repeatedly made shipments abroad using the distribution license number and fictitious HS code of registered products," said Penny. He revealed that in following up on these findings, on August 2, 2023, BPOM carried out enforcement operations as a case development to other facilities, namely the JNE shophouse, the expedition side shop in Depok, and JNT Serpong. During the action, it was found that the products of Montalin (1,140,000 capsules), Ginseng Kianpi Hijau (84,280 capsules), Ginseng Kianpi Gold (196,440 capsules), Samyunwan (432,000 capsules), and Tawon Liar (872,000 capsules) so that the total evidence was 3,524,810 capsules with an economic value of Rp14.1 billion. Based on the findings of the case, his party suspects the suspect is based on Article 196 Jo. Article 98 paragraph (2) and paragraph (3) of Law Number 36 of 2009 concerning Health, perpetrators of this violation face a maximum imprisonment of 10 (ten) years and a maximum fine of Rp. 1 billion. Meanwhile, for producing and/or distributing pharmaceutical preparations and/or medical devices that do not have a business license or distribution permit number, it is threatened with a maximum imprisonment of 15 (15teen) years and a maximum fine of IDR 1.5 billion.

Article 106 paragraph (1) of Law of the Republic of Indonesia Number 36 of 2009 concerning Health as amended by Article 60 number 10 of Law of the Republic of Indonesia Number 6 of 2023 concerning Stipulation of Government Regulations in Lieu of Law of the Republic of Indonesia Number 2 of 2022 concerning Job Creation into Law," he said.
