The Prosecutor's Office Prepares The In Absentia Fugitive Session Of PT Guna Karya Nusantara Boss In The Corruption Case Of The Labuhan Hajj Pier Project

NTB - The East Lombok District Attorney's Office (Kejari) has filed a hearing in absentia in the corruption case of the structuring and dredging of the anchorage pond at Labuhan Haji Pier. The suspect in this case with the initials TR is still at large.

The suspect TR is the Director of PT Guna Karya Nusantara who is the boss of the project implementing partner company at Labuhan Haji Pier for the 2016 fiscal year.

"So, the filing preparation has reached more than 80 percent. Just check with the domicile location concerned in Bandung and conduct an examination of officials in the domicile environment," said Head of the Special Crimes Section of the East Lombok Kejari Isa Ansyori in Mataram, West Nusa Tenggara (NTB), Friday 7 July, confiscated by Antara.

He said the Lombok Kejari took this effort in accordance with the requirements for submitting a trial without presenting the defendant based on a circular from the Deputy Attorney General for Special Crimes at the Attorney General's Office (AGO).

"So, we have to make sure that the person concerned is not in the place according to his domicile in Bandung. If that already exists, we will carry out the unit stage (transmit the files to the investigating prosecutor), then coordinate with the court," he said.

In the previous investigation, the suspect TR was revealed to have joined one of the political parties in Bandung and had an important position. This was also confirmed by Isa Ansyori to be included in the search agenda in Bandung.

In this case, the prosecutor's office named two suspects. Apart from TR, the name Nugroho appeared who acted as the project commitment-making official (PPK).

For the legal process of Nugroho, now he has received permanent legal force from the decision of the Supreme Court of the Republic of Indonesia.

The prosecutor has carried out the execution of the detention of the decision by throwing Nugroho to the Class II BSelong Prison, East Lombok Regency.

The Supreme Court in Nugroho's cassation decision granted the public prosecutor's appeal and canceled the decision of the Corruption Court at the Mataram District Court number: 14/Pid.Sus-TPK/2022/PN Mtr, dated September 21, 2022.

The cassation judge tried himself by imposing a sentence of three years in prison and a fine of Rp. 200 million, subsidiary to three months in prison to Nugroho.

The judge also ordered Bank BNI Main Branch Bandung as the underwriter for the 2016 project down payment to disburse project down payment guarantees worth Rp6.7 billion and submit it to the regional treasury of East Lombok Regency.

The down payment guarantee is in accordance with the disbursement of 20 percent of the project budget which is considered by the judge to be compensation for state losses.

Regarding the replacement money, the prosecutor has carried out the execution by depositing it into the state treasury.

The cassation judge also determined the sentence for Nugroho by stating that he was not proven guilty in the primary indictment of the public prosecutor, but was proven according to the subsidiary charges.

The indictment relates to Article 3 in conjunction with Article 18 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law Number 20 of 2001 in conjunction with Article 55 paragraph (1) of the 1st Criminal Code.

Thus, the judge determined that the detention period that had been served by the defendant was deducted entirely from the sentence imposed. The judge also determined that the defendant should be detained.

From the decision of the first instance court which declared Nugroho free from all prosecutors' demands, there was an order from the judge that all evidence be returned to the prosecutor to be used in the case of the suspect TR, who is now a fugitive from the prosecutor.

The judge in the decision believes that the suspect TR as Director of PT GKN is also responsible for the emergence of state losses in the project.
