The Attorney General's Office (AGO) has stopped prosecuting cases of theft in Mataram City, West Nusa Tenggara (NTB), through a restorative justice mechanism.

Spokesperson for the NTB Prosecutor's Office, Efrien Saputera, explained that the termination of prosecution for the theft case was the result of exposure with the Deputy Attorney General for General Crimes (Jampidum) at the AGO Fadil Zumhanna.

"In accordance with the results of the exposure with Jampidum, the Mataram Kejari's proposal has been approved regarding the request to terminate prosecution of the theft case with a suspect named Hariadi alias Ari alias Pulung through a restorative mediactice mechanism," said Efrien in Mataram, NTB, Thursday, May 11, confiscated by Antara.

In the exposure that took place on Wednesday, May 10, he continued, the AGO's Jampidum also approved the termination of prosecution of cases proposed by the state prosecutor's office in a number of areas.

"So, of the 11 proposed, 10 of them were approved to be resolved through restorative justice. One of those approved was the proposal from the Mataram Kejari," he said.

Efrien also explained that the Mataram Kejari proposed to stop the prosecution of Hariadi's case to the Indonesian Attorney General's Office because it had met the requirements for case settlement through a restorative justice mechanism.

"The first condition is that the suspect has committed a criminal act for the first time. The criminal threat from the Hariadi case is that Article 362 of the Criminal Code is no more than 5 years. The suspect in this case has also recovered the victim's loss," he said.

Important conditions have also been met, namely related to the peace agreement between the victim and the suspect.

"The victim also agreed with the suspect not to continue this matter until the trial," he said.

Following up on the settlement of cases outside the court, he continued, the Attorney General's Office of the Republic of Indonesia has ordered the prosecutor's office to issue a Prosecution Termination Decree (SKP2) based on restorative justice in accordance with the Indonesian Prosecutor's Regulation Number 15 of 2020 and Jampidum Circular Number: 01/EJP/02/2022 dated February 10, 2022 concerning the Implementation of Termination of Prosecution Based on Restorative Justice as a manifestation of legal certainty.
