Expiration Potential Of LP 0204, Victims Of Indosurya: Henry Can Be Free Again

JAKARTA - The Indosurya victim returned to Bareskrim Polri. They questioned how the progress of the police report (LP) he made a year ago.

"I want to ask LP 0204 which was one year ago, until now there has been no further explanation about who the suspect is. Whether the status of the founder of Indosurya is a suspect or not. And whether Henry Surya's wife has been made a suspect or not," said Tommy Suhardi, one of an Indosurya victim, through a written statement received, Wednesday, March 1.

Tommy admits that he has lost IDR 34 billion. Because of that, he made a police report to Bareskrim. The report was received with the number: LP/B/0204/IV/2022/SPKT/BARESKRIM POLRI, on April 27, 2022. The reported parties included Henry Surya, Surya Effendi, and Natalia Tjandra who are Henry's father and wife.

Tommy admitted that he had been waiting for two hours at Bareskrim but did not receive further information regarding the progress of the case.

Tommy's attorney, Adi Nugroho from LQ Indonesia Lawfirm accompanied Tommy so he could also find out how far the police had followed up on his report.

"I know investigators have worked hard from our old report. Only yesterday did I get information that our client was summoned on the new report," said Adi.

Adi believes Bareskrim is speeding up the case process with the model A police report or the report made by the police. However, his party is a little worried because the case with LP Number: A/0086/II/2023/SPKT Dittipideksus Mabes Polri dated 8 February 2023 with the article on counterfeiting and money laundering, has the potential to expire next year.

"Because the deadline is 2012. Meanwhile, based on Article 78 of the Criminal Procedure Code, paragraph 1 point 3 states that threats of more than 3 years can expire in 12 years," he said.

What Adi meant was that he explained that there was a potential expiration so that the incident that freed Henry Surya and his colleagues from legal entanglement would not happen again. Because, according to investigators, they have worked hard in handling the case.

"Not letting this, we look at the old cases, yes, the previous Police Report cases. Bareskrim has worked hard to death, Bareskrim has been desperate, until some officers retired and for years, convenience is only because of the public prosecutor or the prosecutor giving weak charges, weak charges, it makes their previous work in vain. Three years, morning, afternoon, evening, I saw it myself," said Adi.

"That's why we are pushing for LP 0204, which has a long deadline, to be pushed," added Adi.

The attorney team for Indosurya's victim believes that if the Police Report term expires, Henry Surya can no longer be criminally prosecuted, or the prosecution can be canceled for the sake of the law.

"Right now the investigation at the police has only just started, there have been no prosecutions at the prosecutor's office and district court, appeals at the high court, and cassation at the Supreme Court. This could take 2-5 years or more. Don't let the prosecution expire. Don't start a legal process that will eventually make Henry Surya be free again. Poor victims," ​​he joked.

According to him, so far Dirtipideksus and Kabareskrim have been meritorious by successfully transferring Indosurya's previous case files to the prosecutor's office and being tried in court. However, for this effort, said Ali, his party suggested that the Bareskrim investigators process the latest police report (LP 0204).
