Through A Letter, Rafael Alun Trisambodo Refuses To Pay For David Ozora's Restitution
JAKARTA - The father of the defendant Mario Dandy Satriyo, Rafael Alun Trisambodo seemed to let go of the restitution or compensation proposed by David Ozora's camp through the Witness and Victim Protection Agency (LPSK). The reason is that he no longer has the ability because a number of his assets have been confiscated by the Corruption Eradication Commission (KPK).
Starting from Mario Dandy's attorney, Andreas Nahot Silitonga said that Rafael Alun Trisambodo sent a letter. He asked for the letter to be read.
"We received a letter sent from the KPK Detention Center, from Mario Dandy's father, if allowed we will read the letter," said Nahot during a trial at the South Jakarta District Court, Tuesday, July 25.
"What is the link about?" asked Chief Judge Alimin Ribut.
"Restitution, Your Majesty," replied Nahot.
The judge also invited Rafael's letter to be read. It was in that letter that Mario's father refused to pay for the restitution proposed by LPSK.
The letter stated that Mario Dandy was an adult. So, he is considered to be able to account for all his actions that are against the law.
"We convey that with a heavy heart we are not willing to bear the restitution, with the understanding that for people who are adults, the obligation to pay restitution is with the perpetrators of the crime," said Nahot reading Rafael's letter.
Then, in the letter it was also written that Rafael no longer had the ability to pay restitution. Because, after being named a suspect by the KPK, all of his assets have been confiscated
"Currently, we ask to understand the actual financial condition of our family, namely that there is no ability and it is not possible to provide financial assistance. Our family's assets and accounts have been blocked by the KPK in order to determine me as a suspect in a criminal act of alleged gratification," said Nahot.
Meanwhile, the contents of Rafael Alun Trusambodo's letter are as follows:
The panel of judges, Your Majesty, thank God we offered God YME because with his grace and affection, we are all still given health to live this life.
Given the legal process that our son Mario Dandy Satriyo as the defendant who has now reached the evidentiary process, it is our son Mario Dandy Satriyo's turn to exercise his right as a defendant to present a mitigating witness and after discussing with his family, we can basically convey that our son Mario Dandy Satriyo did not use his right to present parents as mitigating witnesses.
That this incident also dealt a blow to our family, our son Mario Dandy Satriyo as the defendant had to stop his studies from Prasetya Mulia University who was still young and so many of our ideals to him. Even our children want to realize their ideals to become children of the nation who work, and serve their service to the country.
However, all plans must turn around because our child is always committed as much as possible to be cooperative in respecting all this legal process. Hopefully there will be a second chance for our child and given space to become a better person.
VOIR éGALEMENT:
Furthermore, regarding restitution, which was conveyed by the victim's family through the Witness and Victim Protection Agency, is the decision of our family, if later there is a decision in the law of our son Mario Dandy Satriyo to pay restitution, then we ask that it be decided according to the applicable law, the main thing regarding our willingness as parents to bear restitution.
We convey that with a heavy heart we are not willing to bear the restitution, with the understanding that for people who are adults, the obligation to pay restitution is with the perpetrators of criminal acts.
"It is true that at the beginning of the incident this case was determined to help the victim's medical expenses, so we ventured to offer assistance for the victim's medical expenses, but at this time we ask to understand the actual financial condition of our family, namely that there is no ability and it is not possible to provide financial assistance. Our assets and family and accounts have been blocked by the KPK in order to determine me as a suspect in an alleged gratification crime.
Thus, we convey this letter with the hope and prayer that the victim David will recover and be healthy as usual. We convey our concern for what has happened. We also thank the panel of judges, Your Honor, for the opportunity given to us to convey our attitude towards restitution in our son Mario Dandy Satriyo's case. Our respect is Rafael Alun Trisambodo.
