Hasya Athallah's Party Received An Invitation Letter From Metro Jaya Police, The Attorney Refused To Come Because It Was Not Based On Law
JAKARTA - Hasya Athallah's legal team and family refused to attend at the invitation of the Traffic Directorate of Metro Jaya Police on Tuesday, January 31, morning. Gita Paulina, one of Hasya's attorneys, revealed that her party did not attend the invitation due to many factors.
"The meeting on January 31, 2023 was a meeting that had no legal basis. Both in the book of criminal procedural law or the Criminal Procedure Code, the regulations of the Republic of Indonesia police, the regulations of the Chief of Police and other regulations," Gita told reporters at the RI Ombudsman's Office, South Jakarta, Tuesday, 31 January.
Gita explained, on Monday, January 30, her party received a letter from the Traffic Directorate for a meeting on Tuesday, January 31 at 09.00 WIB. The letter had been amended several times until finally, we wanted to respond to the letter from Traffic Directorate, because the meeting was initiated by Traffic Directorate and then invited various parties from criminal law experts, the chairman of the ombudsman, and the commission 3 of the DPR including elements from UI both BEM UI, FISIP UI, and Hasha's attorney.
"We did not attend the invitation with all due respect to Traffic Directorate, but we will read out a statement of attitude on the invitation," she said.
The statement stated that Hasya's legal team respected all initiatives and activities carried out by Metro Jaya Police, especially Traffic Directorate related to the traffic accident that had caused Hasya's death.
"However, we hope that all initiatives taken will continue to be carried out in accordance with applicable legal provisions and comply with existing formal procedures, so that they have legal force in handling this case," said Gita.
Gita assessed that Hasya's case was not an ordinary traffic accident case. Hasya's case, she continued, is an example of how a traffic accident has claimed the life of a human and at the same time has damaged the protection of human rights.

"Hasya's case violates the principle of the presumption of innocence, degrades the dignity of the deceased Hasya, undermines public trust in law enforcement officials and in the law itself. This case has the potential to cause damage to public order. Therefore, we cannot attend the invitation," she stressed.
Gita further explained that the purpose of the meeting was not clearly described. In fact, she continued, she had invited various parties, including Commission III of the Republic of Indonesia DPR RI, Chair of Kompolnas, Chair of the Ombudsman, Dean of FISIP UI, Transportation Experts, ATPN Vehicle Experts, Criminal Law Experts to BEM UI.
"That the only information we obtained as a guide to the meeting was the sentence 'in connection with the reference above, we request the list of officials attached to attend an invitation to fact-find the past cases that occurred on October 6, 2022, and so on,'" concluded Gita.
