4 Defendants Sentenced Free, Prosecutors File Cassation In Cases Of Corruption In Cattle Procurement Of IDR 3.4 Billion
BANDA ACEH - The Aceh High Prosecutor's Office stated that the public prosecutor (JPU) filed an appeal to the Supreme Court after the panel of judges acquitted four defendants in a corruption case involving cattle procurement with a work value of Rp3.4 billion.
Acting (Plt.) Head of the Legal Information Section of the Aceh High Prosecutor's Office, Ali Rasab Lubis, said that in the case there were four defendants with two separate files. The file or memorandum of cassation is submitted through the Banda Aceh Corruption Court.
The memory of the appeal was conveyed by the Public Prosecutor Yudhi Saputra from the Aceh Besar District Attorney. The four defendants were Alimin Hasan and Ichwan Perdana Satria as well as Kuswandi and Surya.
Previously, the panel of judges at the Banda Aceh Corruption Court acquitted four defendants on suspicion of corruption in the procurement of cattle at the Livestock Service Office of Aceh Province with a value of Rp. 3.4 billion.
The verdict was read by the panel of judges chaired by Nani Sukmawati accompanied by Sadri and Dedi Harianto respectively as member judges at the trial at the Banda Aceh Corruption Court on June 7, 2022.
The four defendants, namely Alimin Hasan and Ichwan Perdana Satria as the power users of the budget and technical implementing officials (PPTK), as well as Kuswandi and Surya, as contractors for the procurement
In its decision, the panel of judges stated that the defendants were not proven guilty of committing a criminal act of corruption as indicted by the Public Prosecutor. Therefore, they were acquitted of all charges and charges.
In their consideration, the panel of judges stated that the procurement of 225 head of cattle at the Livestock Service Office of Aceh Province in the 2017 fiscal year worth Rp. 3.4 billion was in accordance with the specifications and work contracts.
According to the panel of judges, when the 225 cows were handed over they were in good health. This has been proven by a veterinarian's statement stating that all of the cows were healthy or not sick.
The verdict is not in accordance with the demands of the Public Prosecutor. At the previous trial, the public prosecutor demanded that the defendant Alimin Hasan and the defendant Ichwan Perdana each be 7 years and 6 months and a fine of Rp. 300 million subsidiary to 6 months in prison.
Against the defendants Kuswandi and Surya, the Public Prosecutor demanded a sentence of 8 years and 6 months in prison. The Public Prosecutor also demanded that the two executors of the procurement pay a fine of Rp. 300 million, subsidiary of 6 months in prison.
In addition, the public prosecutor also demanded that the defendants Kuswandi and Surya pay compensation for state losses amounting to Rp1.23 billion. If the defendant does not pay the replacement money, he will be sentenced to 4 years in prison.
