Prosecutor Of Cassation Sentences On Corruption Case Of Ex Head Of DLHP Ambon, Still Wants A Replacement Of Rp. 3 Billion
AMBON - The Ambon District Attorney filed an cassation to the Supreme Court against the verdict of Lucia Izack, the former Head of the Ambon City Environment and Waste Service, in the corruption case for fuel funds for official vehicles in 2019 which cost the state Rp3.4 billion.
"We appealed to the MA (Supreme Court) after the appeal decision of the Ambon High Court Corruption Judges confirmed the decision of the first instance court," said a member of the public prosecutor's office, Chrisman Sahetapy, quoted by Antara, Friday, June 10.
The Prosecutor continued to take the cassation, because the prosecutor's demand to pay a replacement money of Rp. 3 billion was not granted. Lucia was only sentenced to pay a replacement fee of Rp439 million, which according to the prosecutor did not accommodate the prosecutor's demands.
The three defendants for corruption in the BBM budget at the Ambon City DLHP in 2019 were Lucia Izack, Mauritsz Yani Talabesy as Head of Transportation and Cleaning Sector, and the former Manager of the City Rear Gas Station, Ricky M. Syauta.
The amount of state financial losses in this case amounted to Rp. 3.4 billion according to the results of the BPKP Maluku Provincial Representative audit.
The decision of the Ambon Corruption Crimes Panel of Judges sentenced to 5 years in prison and a fine of Rp. 300 million, subsidiary to 4 months in prison and replacement money of Rp. 439 million, subsidiary to 1.5 years in prison.
By the panel of judges, Lucia was proven to have violated Article 2 paragraph (1) in conjunction with Article 18 of the Republic of Indonesia Law Number 31 of 1999 as amended by Law Number 20 of 2001 concerning the Eradication of Criminal Acts of Corruption in conjunction with Article 55 paragraph (1) of the 1st Criminal Code.
Against this decision, Lucia through her legal advisor appealed. The prosecutor also appealed because the prosecutor's demands were 6 years in prison, a fine of Rp.
Mauritsz Yani Talabesy was sentenced to 3.5 years in prison, fined Rp. 100 million subsidiary for 3 months and Ricky M. Syauta was sentenced to 2.5 years and fined Rp. 100 million subsidiary to 3 months.
Both were proven to have violated Article 3 Juncto Article 18 of the Republic of Indonesia Law Number 31 of 1999 as amended by Law Number 20 of 2001 concerning the Eradication of Criminal Acts of Corruption in conjunction with Article 55 paragraph (1) 1 of the Criminal Code.
