JAKARTA - As the latest technology that has rapid development, many countries are starting to make regulations on artificial intelligence (AI) governance, so that they can be developed and used safely and productively.

Indonesia, through the Ministry of Communication and Information Technology, is working on the Circular of the Minister of Communication and Information on Artificial Intelligence Ethics, which is currently in the finalization stage after holding a Focus Group Discussion (FGD) with several stakeholders.

However, because this SE is an ethical reference, the contents of this SE will not regulate any legal entanglement. However, Deputy Minister of Communication and Information Nezar Patria stated that the current legal instruments can be used to take action against perpetrators who are indicated to have violated the law.

"Although we do not yet have special regulations regarding AI, the impact of the use of AI can still be accommodated through existing policies such as the Law on Information and Electronic Transactions and PP on the Implementation of Electronic Systems and Transactions (PSTE)," said Nezar, quoted Thursday, December 14.

"If there is defamation, someone must complain. If there is a violation of the law, report it to law enforcement. It can use the ITE Law, depending on what is violated. For example, pornographic content, later it can be seen in the articles in the Criminal Code which are also regulated," said Nezar.

The Deputy Minister of Communication and Information also mentioned that several countries such as the United States, European Union, China, and Brazil have made various arrangements, in their respective ways.

There is an Executive Order to identify AI's potential and risk as well as a monitoring mechanism so as not to reduce the citizens' fundamental rights. Furthermore, the EU AI Act emphasizes the principles of human-centricity.

On the other hand, Indonesia also has a National Strategy for Artificial Intelligence which is being worked on by the National Innovation Research Agency (BRIN) and the Collaboration of Artificial Intelligence Industry Research and Innovation (KORIKA).

"Stranas is in the process of becoming a Presidential Draft Regulation. In the future, we hope that legally binding regulations and support the development of the national AI ecosystem can be prepared immediately," Nezar hoped.
