When The Corruption Eradication Commission (KPK) Council Rejects Novel Baswedan's Report On Alleged Ethical Violations Committed By Lili Pintauli

JAKARTA - The Supervisory Board of the Corruption Eradication Commission (KPK) refuses to follow up on reports of alleged ethical violations committed by Lili Pintauli Siregar. The deputy chairman of the KPK was reported by former investigators Novel Baswedan and Rizka Anungnata for allegedly communicating with one of the 2020 North Labuhanbatu (Labura) Regency local election  contestants.

Novel Baswdan and Rizka Anungnata reported Lili to the KPK Supervisory Board by letter last week, Friday, October 22. In the report, both said that Lili had communicated with Darno, who was one of the participants in the Labura Pilkada.

"LPS as the reported party, apart from being involved in managing the Tanjungbalai case, is also involved in several other cases, namely those related to the North Labuhanbatu case, which we were handling as investigators," Novel said in the letter.

Through this communication, Darno allegedly asked Lili to speed up the detention of the Regent of Labura Khairuddin Syah who had been named a suspect by the KPK before the 2020 Pilkada began. At that time, Khairuddin again ran as a candidate for incumbent.

"Where this fact was conveyed by the suspect Khairuddin Syah to the reporter at that time. Khairuddin also told the reporter that he had evidence in the form of photos of the meeting between the reported and Darno's brother," Novel said.

Furthermore, he said that the ethics session of the Supervisory Board regarding the alleged ethical violation had been carried out. As reporters, they have also completed the evidence and submitted it to the Secretariat of the Council and received a receipt as of 12 August.

However, in the Dewas Decision Number 5/Dewas/Etik/07/2021 on August 30, the reporter saw that there were no facts on the clarification examination or facts on the ethical trial regarding Lili in the Labura case. Thus, they as reporters submit this complaint to the Supervisory Board.

Closing the letter, Novel and Rizka said they believed the KPK Supervisory Board could process this report. However, their beliefs are inversely related because Tumpak Hatorangan et al decided to follow up on the report.

Member of the KPK Supervisory Board Syamsuddin Haris said that his party had received reports from two former investigators who had been expelled by the KPK as of September 30 for failing to become the state's civil servant. However, the alleged violation was not followed up because it was still unclear or the truth was unclear.

"All reports of complaints of alleged ethical violations that are still vague will not be followed up by the Council," said Syamsuddin.

"It must be clear what the facts were, when it was carried out, who the witnesses were, what was the initial evidence," he said.

"If it is reported that LPS communicated with the 2020 Pilkada contestants in North Labuhanbatu (Labura) Regency, it must be clear what the contents of the communication allegedly violated the ethics of," added Haris.

Tumpak Hatorangan et al's decision not to follow up on Lili's alleged ethical violation was highlighted by Indonesia Corruption Watch (ICW) researcher Kurnia Ramadhana. According to him, the KPK Supervisory Board should have followed up and even immediately held a trial and scheduled a summons for Lili.

"ICW views that the Supervisory Board should hold a trial and schedule a summons for Lili," said Kurnia in her written statement.

According to him, if the meeting is proven, Lili could be given severe sanctions for violating Article 4 paragraph (1) letter d, Article 4 paragraph (2) letter a, Article 4 paragraph (2) letter b, Article 7 paragraph (2) letter b. Supervisory Board Regulation Number 02 of 2020.

"ICW and the public certainly do not expect that when Lili's actions are proven to have violated the code of ethics, the Supervisory Board will only impose sanctions in the form of salary cuts. However, the appropriate punishment for Lili is a severe sanction with a recommendation for her to resign as a KPK Commissioner," said the activist. this anti-corruption.

The sanctions, continued Kurnia, were deemed necessary because the current anti-corruption commission had been rotten and collapsed due to the actions of its leadership. The reason is that it is not only Lili who has been sentenced to severe sanctions in the form of salary cuts, but the Chairperson of the KPK, Firli Bahuri, has also been declared a minor ethical violation after boarding a helicopter for personal purposes.

"For ICW, the Corruption Eradication Commission (KPK) has been rotten and collapsed due to the behavior of its own commissioners. Why not, if the LPS is proven, two commissioners have violated the code of ethics twice," said Kurnia.

"On that basis alone, it is appropriate that the two people, both Firli and Lili, immediately leave the KPK. Not only that, all KPK commissioners are also known to have violated human rights and administration based on the findings of Komnas HAM and the Indonesian Ombudsman regarding the implementation of the National Insight Test (TWK)," he concluded.
