A Farmer In Medan Is Sentenced To 1 Year In Prison For Harassing The Wives Of KRI Nanggala 402 Crew

MEDAN - The defendant in the case of harassment of the wives of the crew of KRI Nanggala 402 on social media, Imam Kurniawan was sentenced to 1 year in prison.

The Medan farmer was also sentenced to a fine of IDR 100 million, subsidiary to 3 months in prison by the panel of judges at the Medan District Court.

Based on a search from the Medan District Court Case Tracing Information System (SIPP) seen on Monday, August 30, this decision was handed down by Dominggus Silaban as chairman of the panel of judges in this case on Friday, August 27.

In its decision, the panel of judges stated that the resident of Medan Marelan Sub-district was legally and convincingly guilty of committing a crime as referred to in the indictment of violating Article 28 Paragraph (2) in conjunction with Article 45A Paragraph (2) of Law No. 19 of 2016 concerning Amendments to Law of the Republic of Indonesia Number 11 of 2008 concerning Information and Electronic Transactions.

"Impressing the defendant in the form of imprisonment for one year with an order to remain detained, a fine of IDR 100 million, subsidiary of 3 months in prison", the verdict read

This decision is the same as the demands made by the Public Prosecutor Endang Pakpahan.

In the indictment of Public Prosecutor Endang Pakpahan, it is stated that this harassment case began on Sunday, April 25, when the defendant opened his Facebook application.

On the homepage of his Facebook account, he saw an upload (post) of a Facebook group account with the group name "Alliance of Coolies throughout Indonesia (AKSI) containing the words "For all coolie friends. For a moment, let's pray for the heroes who died in their duty to protect our maritime sovereignty. For the crew of KRI NAGGALA "Fair wind and following Seas, KRI Nanggala. Commence the Eternal Patrol".

"The defendant, who is a member of the All-Indonesian Coolie Alliance (AKSI) facebook group account, read the post and immediately wrote a comment from the defendant's own Facebook account on behalf of Imam Kurniawan in the form of a sentence. When your submarine sank there your wife xx xxx, who if it is interpreted as having the meaning 'when KRI Nanggala 402 sank, that's when the wife of a member of the Indonesian Navy (the crew of KRI Nanggala 402 who had died) was raped by the defendant'", explained the Public Prosecutor in the previous trial.

Then, the defendant's post spread on social media. The post was read by witness Alwi Rosaini Manurung, who is a member of the Indonesian Navy Lantamal I Belawan. On orders from Danpomal, he reported the defendant to the Belawan Harbor Police for legal processing.

"Because the posts/writings published by the defendant in the comments column are considered as actions that provide negative information to cause hatred, so that there is also a negative response in the form of anger from the family and all members of the Navy who are in a state of mourning over the sinking of KRI Nanggala 402 in where the entire crew of KRI died", explained the Public Prosecutor.
