President Director Of Totalindo Eka Persada Donald Sihombing Tanah Rorotan Corruption Suspect Detained By KPK

JAKARTA - North Director of PT Totalindo Eka Persada, Donald Sihombing officially has an orange dream. He was detained by the Corruption Eradication Commission (KPK) for being dragged into allegations of corruption in land acquisition in Rorotan, Cilincing, North Jakarta.

"Detention was carried out at the Red and White KPK Building Branch Detention Center," said KPK Investigation Director Asep Guntur Rahayu at a press conference at the KPK's Merah Putih building, South Jakarta, Wednesday, September 18.

The entrepreneur who was listed as the 14th richest person in Indonesia according to Forbes in 2019 was named along with four other people as suspects. Asep detailed that the four were former President Director of Perumda Pembangunan Sarana Jaya, Yoory C Pinontoan; Senior Manager of the Business Division or Director of Perumda Pembangunan Sarana Jaya, Indra S Arharrys; Commissioner of PT Totalindo Eka Persada, Saut Irianto Rajagukguk; and Finance Director of PT Totalindo Eka Persada, Eko Wardoyo.

"The KPK then detained the suspects for the first 20 days, starting from September 18, 2024 to October 7, 2024," he said.

In this case, Asep explained that PT Totalindo Eka Persada is one of the companies that offers land to Perumda Pembangunan Sarana Jaya whose job is to provide land banks or land banks.

Then this regional company purchased 12.3 hectares of land in Rorotan, North Jakarta from PT Totalindo Eka Persada worth IDR 371.5 billion in 2019. In fact, the private company paid cheaper to PT Nusa Kirana Real Estate or PT NKRE as the owner of the land.

The land was purchased by PT Totalindo Eka Persada from PT NKRE for IDR 950,000 per square meter which was calculated as payment of PT NKRE's debt to PT Totalindo Eka Persada with a total transaction value of IDR 117 billion. As a result, the state lost around IDR 223.8 billion.

"The value of state or regional losses comes from the net payment received by PT Totalindo Eka Persada from Perumda Pembangunan Sarana Jaya amounting to Rp371.5 billion minus the real transaction price of PT Totalindo Eka Persada with the initial land owner, PT Nusa Kirana Real Estate after taking into account other related costs such as taxes, BPHTB and notary fees totaling Rp147.7 billion," he explained.

Not only markers, land acquisition in Rorotan occurs due to several irregularities. Among them, Asep said, Yoory directed not to appoint an independent public appraisal service office (KJPP) to assess land prices.

In addition, PPSJ has also not conducted an internal study regarding the KSO offer from PT Totalindo Eka Persada. All of these fraudulent practices were carried out because Yoory allegedly received facilities from PT Totalindo Eka Persada.

Asep said Yoory allegedly received a foreign exchange in Singapore dollars worth IDR 3 billion from PT Totalindo Eka Persada. He is also said to have obtained facilities or convenience in the sale of personal assets purchased by private company employees.

"The purchase of YCP's brother's assets in the form of a house and an apartment unit by the PT TEP employee was instructed by Brother EKW and the source of the funds came from the company's cash in the form of soft loans to employees who bought the assets," said Asep.

For the alleged crime, Yoory, Donald Sihombing, and three other suspects were charged with Article 2 paragraph (1) or Article 3 of Law Number 31 of 1999 as amended by Law Number 20 of 2001 concerning Eradication of Corruption in conjunction with Article 55 paragraph (1) 1st of the Criminal Code.
