CIREBON - The Public Prosecutor's Team (JPU) rejected the novum or new evidence from the team of attorneys for the six convicts in the effort to review the cases of the deaths of Vina and Eky in Cirebon, West Java, because they were not based on law.
"The proposed novum is not legally acceptable because it cannot be categorized as relevant new evidence for consideration in this trial," said Sunarno, a member of the public prosecutor, when giving a response at the PK trial at the Cirebon District Court (PN) as reported by ANTARA, Monday, September 9.
The prosecutor is of the view that the novum submitted by the PK applicant is considered ineligible as new evidence.
His party assessed that several files and information submitted by legal counsel for the convicts could not be accounted for as a novum for this PK effort.
"The reasons proposed regarding the conflict of decisions in this case are considered not strong enough," he said.
On the other hand, the Public Prosecutor also believes that the statements from several witnesses submitted by the legal team cannot be considered as legal new evidence.
In addition, several other witnesses who were claimed to have witnessed the accident in August 2016 were also considered to have made enough contribution to be used as new evidence.
"The statements of the witnesses submitted have been considered by the previous panel of judges (in 2016). So that they cannot be used as the basis for the novum in this trial," said Sunarno.
Meanwhile, Jutek Bongso, a representative of the attorneys of the six convicts, said that the Public Prosecutor only gave formal responses without touching the substance of the principal matter from the proposed novum.
In PK's memory of this case, his party included many novums explaining the events of Vina and Eky's death, as well as the true description of the case.
He emphasized that although there was a difference of opinion between his party and the respondent, the PK process continued in accordance with applicable regulations.
"It's okay, each of them has an opinion. But we will see later the results that can be obtained from the witnesses and the evidence presented," he said.
Jutek said the legal team had systematically compiled PK memory both formally and materially, and the final decision was entirely submitted to the panel of judges at the Supreme Court (MA).
"We present facts that were not revealed in the previous trial," he said.
