KPU Asked To Disqualify Caroll Senduk-Sendy Rumajar Pair In Tomohon City Election

The General Election Commission (KPU) was asked to disqualify the Caroll Senduk and Sendy Rumajar pairs in the Tomohon Regional Election, North Sulawesi. This is because Caroll Senduk, who is the incumbent City Guard, has allegedly violated the Pilkada Law for replacing officials during the Pilkada period.

The open letter to the KPU was conveyed by the Indonesian Pilkada Monitoring Community consisting of the Indonesian Anti-Corruption Committee (KAKI) and the Pro-Democracy Advocates Association (PAPD). Apart from the KPU, open letters were also sent to Bawaslu.

"That there has been a change of position in the Tomohon City Government on March 22, 2024, at the Tomohon Mayor's meeting room. Rolling is marked by taking oaths and promises of 19 officials within the Tomohon City Government," said the Coordinator of the Indonesian Pilkada Monitoring Community, Arifin Nur Cahyono, Thursday, September 5.

"It is suspected that the inauguration was carried out by the Mayor of Caroll Senduk which was also attended by the Regional Secretary of Tomohon City Edwin Roding, the Head of Personnel and Human Resources Development (BKPSDM) of Tomohon City, Djon Sonny Liuw, Pastor Yosua Wangka and the ranks of the Tomohon City Government," he added.

Arifin revealed that as many as 19 officials who were sworn in on March 22, 2024, began carrying out their duties on Monday, March 25, 2024 based on the decree which was read collectively during the inauguration. Meanwhile, the inauguration, he said, had not yet received an official permit from the Ministry of Home Affairs.

"The Tomohon City Government has just asked the Ministry of Home Affairs for permission on March 29, 2024," he said.

Therefore, continued Arifin, Caroll Senduk as a Candidate for Mayor of Tomohon has committed a serious violation of the law. Considering that the Indonesian Election Supervisory Agency (Bawaslu) has confirmed that regional heads are prohibited from replacing officials ahead of the 2024 Pilkada, starting from March 22, 2024.

"In order to prevent violations and process disputes and ensure the election of Governors and Deputy Governors, Regents and Deputy Regents, as well as the democratic and integrity Mayors and Deputy Mayors of 2024, in order to ensure consistency of legal certainty, as well as an effective and efficient process of holding elections," said Arifin.

Arifin emphasized that Caroll Senduk was sentenced to criminal sanctions as stipulated in Law Number 10 of 2016 concerning Pilkada. Where the transfer ban applies 6 months before the determination of the candidate pair for regional head by the Indonesian KPU.

"Caroll Senduk is an official who violates the provisions of Article 71 paragraph (2) or Article 162 paragraph (3) shall be sentenced to a minimum imprisonment of 1 (one) month or a maximum of 6 (six) months and/or a fine of at least Rp. 600,000.00 (six hundred thousand rupiahs) or a maximum of Rp. 6,000,000.00 (six million rupiahs)," said Article 190 of the Pilkada Law, "explained Arifin.

"Furthermore, we ask to hear and process allegations of serious and intentional violations by the Prospective Mayor of Tomohon Caroll Senduk in the 2024 regional elections," he concluded.
