Rizieq's Offline Trial Granted, Hidayat Nur Wahid: Judges Consider Conscience And Legal Justice

JAKARTA - Deputy Chairman of the Indonesian People's Consultative Assembly, Hidayat Nur Wahid (HNW), appreciates the panel of judges at the East Jakarta District Court (East Jakarta District Court) who granted the request to hold an offline trial in the case of the defendant Rizieq Shihab.

"The decision of the panel of judges who finally allowed the live or offline trial shows that the judges are still considering the demands of conscience and legal justice", said HNW in a press statement written on Friday, March 26.

He hopes that the legal justice orientation attitude of the panel of judges can continue with the subject matter of the crowd case, including for other cases such as the case that was beaten to the General Chairperson of the Islamic Defenders Front (FPI) and other FPI leaders.

"Not only following the public prosecutor but also listening to legal and logical arguments from and their attorneys. This fair attitude needs to be supported so that it becomes a good precedent, and so that judges can decide the subject matter properly and fairly", explained the PKS Party Politician.

The member of Commission VIII of the House of Representatives (DPR) also assessed that the appointment of the panel of judges for the trial to be conducted offline shows that the principles of due process of law and equality before the law. Namely, legal processes that are fair and impartial, not selective, appropriate, and have gone through existing legal mechanisms and procedures to obtain substantive justice.

"The principle of due process of law and equality before the law is one of the requirements for the formation of a rule of law, as mentioned in Article 1 paragraph (3) of the 1945 Constitution of the Republic of Indonesia", he explained.

In addition, HNW reminded that although Rizieq Shihab and other FPI leaders had the status of defendants, their constitutional rights as Indonesian citizens were still inherent. One of the constitutional rights he has, based on Article 28D paragraph (1) of the 1945 Constitution of the Republic of Indonesia is the right to recognition, guarantee, protection, and legal certainty that is just and equal treatment before the law.

For this reason, HNW asks all parties, both the public prosecutor and Rizieq Shihab, as well as their attorneys and their supporters, to respect the decision of this panel of judges by keeping the trial process running in a conducive way.

"Therefore, the supporters of Habib Rizieq should really follow the calls and requests of the high priest of the FPI not to be anarchist, and not to crowd to court, it is enough to watch the trial and pray from their homes", he said.

Likewise, law enforcement officials should persuasively and not repressively maintain conducive conditions for the offline trial of Habib Rizieq to be held. HNW hopes that the police and apparatus can act decisively if there are intruders who certainly want to destroy.

"So that the offline trial can continue to be held so that the panel of judges can decide the final verdict in accordance with the law, truth, and justice as expected by all parties", concluded HNW.
