The Attorney General's Office Respects The Supreme Court's Decision Which Was Sentenced To The Ex-Director Of BAKTI Kominfo

JAKARTA - The Attorney General's Office (AGO) respects the decision of the Supreme Court (MA) which cut the prison sentence of former BAKTI President Director Kominfo Anang Achmad Latif from 18 years to 10 years in prison in the 4G BTS corruption case.

He said the decision was an cassation decision, so it had permanent legal force.

"This has been a decision by the Supreme Court, right, and this has been the last legal attempt, it has permanent legal force, so we respect the court's decision," said Head of the Legal Information Center (Kapuspenkum) of the Attorney General's Office, Harli Siregar, quoted from Antara, Saturday, July 27.

However, the Prosecutor's Office is still waiting for a copy of the decision file to determine the next steps.

It is known, in the Supreme Court's decision Number 4103 K/Pid.Sus/2024 it was stated that the sentence handed down to Anang Achmad Latif was changed to 10 years from being previously sentenced to 18 years in prison.

Meanwhile, the fine imposed at the cassation level is still the same as the decision of the Corruption Court at the Central Jakarta District Court, which is Rp. 1 billion, subsidiary to 6 months in prison. In addition, the replacement money sentence decided by the Supreme Court is also the same as the Jakarta Corruption Court, which is Rp. 5 billion.

The decision was decided by Desnayeti as Chair of the Assembly with two members, Agustinus Purnomo Hadi and Yohanes Priyana on Thursday, July 18, 2024.

Previously, the Jakarta Corruption Court sentenced Anang Achmad Latif to 18 years in prison and a fine of Rp. 1 billion, subsidiary to 6 months in prison.

In its ruling, the panel of judges also sentenced Anang Achmad Latif to pay a replacement fee of Rp. 5 billion no later than one month after the decision had permanent legal force or inkrah.

The panel of judges stated that he was legally and convincingly proven guilty of committing a criminal act of corruption together and the Crime of Money Laundering (TPPU), in the provision of base transceiver station (BTS) 4G infrastructure and supporting infrastructure packages 1, 2, 3, 4, and 5 BAKTI Kemenkominfo in 2020-2022.

He was declared proven guilty of violating Article 2 paragraph 1 in conjunction with Article 18 of the Anti-Corruption Law jo. Article 55 paragraph 1 1 of the Criminal Code and Article 3 of the Law on the Prevention and Eradication of the Crime of Money Laundering (TPPU).
