Badung Prosecutor's Office Files An Appeal For The Murder Of Youth In Sempidi Bali

The Badung District Attorney's Office (Kejari) has filed an appeal against the Denpasar District Court (PN) decision in the murder case of a young man Adhi Putra Krismawan in Sempidi, Badung Regency, Bali. Head of the Badung Kejari Sutrisno Margi Utomo said the Public Prosecutor's Office of the Badung Kejari declared an appeal through the Denpasar District Court against the case of Roni Saputra and his friends.

In this case, the defendants were proven to have committed violence together against the victim on behalf of Adhi Putra Krismawan which resulted in the victim's death.

Kajari Badung Sutrisno Margi Utomo explained that there were two considerations so that the Public Prosecutor declared an appeal against the judge's decision.

First, there is a different decision between the decision of the child perpetrator (AmF convict) and the case of Roni Saputra and his friends in the same case.

"In the case of child perpetrators (AMF), the Panel of Judges found guilty of violating Article 340 Juncto Article 55 paragraph 1 of the Criminal Code, while for the verdict of the case with the defendant Roni Sahputra (adult) on July 18, 2024, the Panel of Judges decided guilty of violating Article 170 paragraph 3 of the Criminal Code with a prison sentence of seven years," he said in Denpasar, Bali, Wednesday, July 24, confiscated by Antara.

Furthermore, the consideration of the two prosecutors to appeal is that the decision of the Panel of Judges in the Roni Saputra case has not fulfilled the sense of justice in society.

"This can also be seen from the negative response of the community to the decision," he said.

The memorandum of appeal was submitted Wednesday, July 24, 2024, to the Denpasar District Court.

Previously, the panel of judges in a separate case in the same case had sentenced the perpetrators of AMF's child to six years in prison and determined that the period of arrest and detention that the AMF perpetrators had served was deducted entirely from the length of the sentence imposed.

The verdict was decided on Tuesday, February 20, 2024 by the judge I Wayan Suarta at the Denpasar District Court.

Furthermore, on Thursday 18 July 2024, six martial arts players who killed Buleleng Adhi Putra Krismawan (23) in Sempidi, Mengwi, Badung were sentenced to seven years in prison by the Denpasar District Court Panel of Judges.

The panel of judges led by Ida Bagus Bamadewa Patiputra sentenced each defendant Roni Saputra alias Roni (21), Bima Fajar Hari Saputra alias Bima (18) Ocshya Yusuf Bahtiar alias Allah (21) Ahmat Hilmi Mustofa alias Hilmi (24) Pujito alias Utak (31) and Siswantoro (42), to imprisonment for seven years because they were legally and convincingly proven guilty of molestation resulting in the death of the victim.

The verdict is in accordance with the second alternative indictment of the primary Public Prosecutor as stipulated in the provisions of Article 170 paragraph (2) of the 3rd Criminal Code (KUHP).

The sentence given by the judges to the defendants was 10 years lighter than the demands of the Badung District Attorney Imam Ramdhoni. In the prosecutor's indictment, six defendants were sentenced to 17 years in prison for premeditated murder of the victim as regulated in Article 340 of the Criminal Code regarding premeditated murder.

Previously in the prosecutor's indictment, it was revealed that the actions of the six defendants began when they received a WhatsApp message in the PSHT silat group group (Perdarakatan Setia Hati Teratai) which asked members to gather in front of Citra Land Housing, North Denpasar, on Monday, April 15, at around 20.30 WITA.

The purpose of the call to gather is to find members of the IKSPI silat (Ikatan Keluarga Silat Putra Indonesia) or commonly called "Kerakti" to take revenge. Because according to the defendant's statement, a few days earlier in Sidoarjo Regency, East Java, members of PSHT were beaten, killed and there were also members of PSHT women who were harassed by IKSPI members.

Then, at around 23.30 WITA, the PSHT member came from the front of Citra Land Housing to the T-junction of the Hanoman Statue of Sempidi. At that time, the defendants saw that one IKSPI member was using a motorbike. So they immediately chased him, but the person was able to escape.

Not long after, they saw three motorbikes walking hand in hand. The two motorbikes riding were members of IKSPI while the other one alone was victim Adhi Putra Krismawan. The defendants and members of PSHT shouted and tried to block them. However, the two motorbikes riding the IKSPI members were able to escape, while the victim fell and hit the pole.

Seeing the victim fall, the defendants immediately beat and thought that the victim was a member of IKSPI. They hit, kicked, hit using pots and Roni who stabbed the victim's chest with a sharp weapon. Furthermore, the defendants left the victim to death covered in blood. It was finally revealed that the victim was not a member of the Sacred Kera, which means they were wrongly targeted.
