Former Director General Of The Ministry Of Home Affairs Sued 5 Years 4 Months In Prison For Bribery Of PEN Muna Funds

JAKARTA - Former Director General of Regional Finance at the Ministry of Home Affairs Mochamad Ardian Noervianto was sentenced to imprisonment for 5 years and 4 months in the case of alleged bribery for the submission of the National Economic Recovery (PEN) funds for Muna Regency in 2021 2022.

"Sentenced Defendant M. Ardian Noervianto in the form of imprisonment for five years and four months and a fine of Rp. 250 million, subsidiary to imprisonment for six months," said the public prosecutor of the Corruption Eradication Commission (KPK) at the Jakarta Corruption Court, reported by ANTARA, Wednesday, June 26.

In addition, Ardian was also required to pay compensation of Rp2,876,999,000. With the provision that if the fine is not paid 1 month after the decision has permanent legal force, then his property can be confiscated and auctioned off or sentenced to 2 years in prison.

"Punishing the defendant with an additional penalty in the form of replacement money to the state of Rp2,976,999,000 minus Rp100 million as evidence, so that the remaining replacement money that must be paid by the defendant is Rp2,876,999,000," said the prosecutor.

According to the prosecutor, Ardian's actions did not support the government's program in realizing a government that was free from collusion, corruption, and nepotism (KKN). In addition, his actions are also considered to undermine public trust in state institutions.

As a consideration of mitigating, Ardian has family responsibilities, and he is considered polite and respects the trial.

The prosecutor stated that he was legally and convincingly proven guilty of committing a criminal act of corruption together and continuing.

He is considered proven guilty of violating Article 12 letter a in conjunction with Article 18 of Law of the Republic of Indonesia Number 31 of 1999 concerning Eradication of Corruption in conjunction with Article 55 Paragraph (1) 1st of the Criminal Code in conjunction with Article 64 paragraph (1) of the Criminal Code.

On Wednesday, September 28, 2022, Ardian was also sentenced to 6 years in prison and a fine of Rp250, subsidiary to 3 months in prison in the case of accepting bribes for the approval of loan funds for the East Kolaka Regency PEN program in 2021.

In addition, Ardian was also sentenced to pay compensation to the state in the amount of 131,000 Singapore dollars. If the replacement money is not paid no later than 1 month after the court's decision obtains a final legal decision, his property is confiscated by the prosecutor and auctioned off to cover the replacement money or sentenced to one year in prison.
