The Directorate General of AHU at the Ministry of Law and Human Rights inaugurated 154 Civil Servant Investigators (PPNS) from three ministries and BPOM. It is hoped that PPNS will be able to work professionally and can coordinate well in terms of good governance.

In accordance with Government Regulation Number 58 of 2010 concerning Amendments to Government Regulation Number 27 of 1983 concerning Implementation of Criminal Procedure Code (Article 3H), the Directorate General of AHU has a strategic role as a Trustee of PPNS Administration.

Several PPNS ministries and supervisory agencies include; PPNS of the Directorate General of Customs and Excise, PPNS of the Directorate General of Water Resources of the Ministry of Public Works and Public Housing (PUPR), PPNS of the Directorate General of Electricity at the Ministry of Energy and Mineral Resources, PPNS of the Downstream Oil and Gas Regulatory Agency of the Ministry of Energy and Mineral Resources, and PPNS of BPOM.

Criminal Director Haris Sukamto said that the Directorate General of AHU has the duty to verify the administration, appointment and dismissal of PPNS, transfer and take the oath of promise of PPNS based on Permenkumham Number 5 of 2016 concerning Procedures for Appointment, Inauguration and Making of Oaths or Promises, Transfers, Dismissal and Re-appointment of PPNS and Introduction Cards of PPNS.

The Directorate General of AHU also launched the PPNS Online application to speed up the process of applying for PPNS services, starting from administrative verification, appointment, inauguration, transfer, extension, dismissal to reporting PPNS activities by regional offices.

"The Directorate General of AHU of the Ministry of Law and Human Rights as the supervisor of PPNS realizes how important it is to strengthen the role and existence of PPNS in law enforcement tasks in the community to be carried out immediately so that the quality of public service administration is increasing and of course the legal certainty is getting better," said Haris Sukamto during the inauguration of PPNS at the Oemar Seno Adji Building. Directorate General of AHU of the Ministry of Law and Human Rights, South Jakarta, Tuesday, June 25.

Haris added that strengthening the role of PPNS must continue to be carried out through various kinds of human resource competency development, especially related to expertise in carrying out supervisory, observational, research or examination (wasmatlitric) tasks and criminal investigations so that in the future PPNS is expected to be more professional, independent and confident in carrying out law enforcement tasks.

"We together with stakeholders, namely the Police and the Prosecutor's Office, will continue to coordinate and monitor issues and criminal legal issues that occur," he said.

"Coordination in terms of realizing good governance, the role of PPNS in handling special criminal offenses, as well as the mechanisms and procedures for submitting case files to be declared complete (P21) by the supervisor (Biro Korwas PPNS)," he added.

In addition, in order to encourage the role of regional offices as representatives of the Ministry of Law and Human Rights in the regions, the authority is given to carry out the inauguration of PPNS so that this inauguration can also be held at the Regional Office of the Ministry of Law and Human Rights in each province.

Speaking of PPNS, Haris explained, Civil Servant Investigators (PPNS) according to Article 6 paragraph (1) of Law Number 8 of 1981 concerning the Criminal Procedure Code (KUHAP) are certain civil servant officials who are given special authority by law which is the basis of their respective laws and in carrying out their duties are under the coordination and supervision of police investigators.

With the enactment of Law Number 1 of 2006 concerning Mutual Assistance in Criminal Problems, it provides a legal basis for the Minister of Law and Human Rights as an official in the authority (Central Authority) who acts as the coordinator in submitting requests for mutual assistance in criminal matters to foreign countries as well as handling requests for mutual assistance in criminal matters from foreign countries.

"The task of the Central Authority is to obtain evidence from foreign countries, so PPNS in collaboration with the Police requires coordination with the Ministry of Foreign Affairs (Diplomatic Channel), Police, Attorney General's Office, KPK, PPATK and the Ministry of Law and Human Rights (Central Authority) to find out assets that can be confiscated, searched, blocked by agencies authorized in foreign countries," he said.

Likewise, a PPNS needs to understand how to coordinate with the Police to request the surrender of a suspect / defendant of an Indonesian citizen who is suspected / convicted of committing a crime outside the territory of the Republic of Indonesia based on the Extradition agreement with the country, as stipulated in Law Number 1 of 1979 concerning Extradition.

Haris also reminded the importance of PPNS tasks in various ministries such as PPNS of the Directorate General of Customs and Excise, PPNS of the Directorate General of Water Resources of the Ministry of Public Works and Public Housing (PUPR), PPNS of the Directorate General of Electricity of the Ministry of Energy and Mineral Resources (ESDM), PPNS of the Downstream Oil and Gas Regulatory Agency of the Ministry of Energy and Mineral Resources, and PPNS of BPOM, to stick to applicable laws related to irregularities in criminal acts.

Haris explained that the PPNS that had been chosen by the leadership in its place of duty would then be trained and educated at the Megamendung Police Criminal and Investigation Education Institute (Lemdik), Bogor, West Java.

"The hope is that after being inaugurated as a Civil State Investigator Officer by the Ministry of Law and Human Rights can become a state civil servant (ASN) who is professional and with integrity and is competent in carrying out his authority as an investigator in enforcing the law that you oversee," he concluded.
