JAKARTA - The Corruption Court (Tipikor) at the Central Jakarta District Court will again try the case of former Supreme Court Justice Gazalba Saleh.

The case was continued according to the decision of the DKI Jakarta High Court which granted the appeal against the Corruption Eradication Commission (KPK) against the interlocutory decision of Gazalba Saleh.

"Of course it will be rescheduled when PT (High Court) orders to continue examining this case," said Central Jakarta District Court Public Relations official Zulkifli Atjo, quoted by ANTARA, Tuesday, June 25.

Zulkifli said that his party was still waiting for a copy of case decision number 35/PID.SUS-TPK/2024/PT DKI. He emphasized that the Jakarta Corruption Court would carry out a high court order.

"Of course we have to wait for the decision officially from PT (High Court) DKI. We will see the decision's order," he said.

Previously, the panel of judges at the Corruption Court at the Central Jakarta District Court, Monday (27/5), granted a memorandum of objection or exception from the team of legal advisers to Gazalba Saleh.

The corruption court ruled that the prosecution and indictment of the KPK public prosecutor could not be accepted, and ordered Gazalba Saleh to be immediately released from custody.

Then, the Head of the KPK News Section, Ali Fikri, Wednesday (29/5), stated that the KPK prosecutor team filed a fight (verzet) against the interim decision.

Meanwhile, Monday (24/6), the DKI Jakarta High Court decided to accept the request for an appeal against the KPK.

"To try, accept the request for an appeal against the public prosecutor," said Chief Judge Subachran Hardi Mulyono reading the verdict.

The DKI Jakarta High Court then canceled the decision of the Corruption Court at the Central Jakarta District Court which granted Gazalba Saleh's objection note.

The high court also stated that the indictment in the name of Gazalba Saleh had met the formal and material requirements, as stipulated in Article 143 paragraph (2) letter a and letter b of the Criminal Procedure Code.

Therefore, the DKI Jakarta High Court ordered the Jakarta Corruption Court to continue the Gazalba Saleh case.

"Ordered the Corruption Court at the Central Jakarta District Court which tried the quo case to continue to try and decide the quo case," added Subachran.

In the case in question, Gazalba Saleh was charged with receiving gratuities and committing money laundering (TPPU) with a total value of Rp. 25.9 billion related to the handling of cases at the Supreme Court (MA).

On the gratuity charges, Gazalba is threatened with criminal charges in Article 12 Bjuncto Article 18 of Law (UU) Number 31 of 1999 concerning the Eradication of Corruption as amended by Law Number 20 of 2001 in conjunction with Article 55 paragraph (1) 1 of the Criminal Code.

Meanwhile, on the TPPU indictment, Gazalba was threatened with criminal charges under Article 3 of Law Number 8 of 2010 concerning Prevention and Eradication of TPPU in conjunction with Article 55 paragraph (1) of the 1st Criminal Code in conjunction with Article 65 paragraph (1) of the Criminal Code.
