MATARAM - A patient with breast cancer from Plampang, Sumbawa Regency, Mastampawan submitted a summons to the West Nusa Tenggara Provincial General Hospital regarding allegations of malpractice in the medical treatment process.
"The purpose of this subpoena is to ask for an explanation as well as accountability from the NTB RSUP for medical actions that resulted in the swelling and pussing of our client's left hand," said Abdul Hanan, Mastampawan's attorney in Mataram, Antara, Thursday, June 20.
The patient's family had previously asked for an explanation from the hospital on June 10, 2024, regarding what caused swelling and swelling on Mastampawan's left hand.
"So, the family saw the swelling and swelling on Mastampawan's left hand after the nurse injected liquid into our client's left hand. The reaction appeared less than a day after the injection. That's why you were asked what liquid was injected until the reaction was like that?" he said.
The family has met with dr. Rampant Indriawan who handled Mastampawan's treatment, just two days after the reaction appeared on June 12, 2024.
"It was during the patient's visit, dr. Perseks checked the health of our client, but from the meeting the family did not get a medical explanation as to why the swelling and pusiness could occur to our clients," he said.
Obtaining such a response, the family appointed Hanan as a legal representative to submit a summons to the NTB RSUP.
"Our summons letter was sent today and immediately addressed to the President Director of the NTB RSUP," said Hanan.
In the letter, the attorney gave the NTB RSUP a time limit of up to three days to respond in the form of accountability for the reaction of liquid injection on Mastampawan's left hand.
"If within three days from this summons we fly there is no good faith from the NTB RSUP, we will seek to resolve this problem through the legal process," he said.
According to Hanan, this alleged malpractice act can refer to criminal violations of Article 359 of the Criminal Code, Article 360 of the Criminal Code and Article 361 of the Criminal Code in conjunction with Article 190 paragraph (1) of Law Number 36 of 2009 concerning Health.
The President Director of NTB Hospital, dr. Then Herman Mahaputra invited the patient to send a summons.
"Actually, we have explained this issue to the patient's family. But if you want a subpoena, just go ahead. It's okay, go ahead," said Lalu Herman.
