JAKARTA - PKB filed a lawsuit against the results of the General Election of Legislative (Pileg) of the DPRD for Electoral District 3 of North Halmahera Regency, North Maluku. The lawsuit was filed because of the loss of one candidate for legislative member (caleg) they carried.
This was revealed in a panel of two preliminary examination hearings for the 2024 Pilleg General Election Result Dispute (PHPU) case which was held at the Constitutional Court Building (MK), Jakarta, Tuesday, April 30.
The trial was chaired by Deputy Chief Justice of the Constitutional Court, Saldi Isra, as chairman of the panel accompanied by Constitutional Justices Ridwan Mansyur and Arsul Sani. Valid as the Petitioner is PKB and valid as the Respondent is the KPU.
PKB attorney Zulfikran A. Bailussy said the alleged reduction of one vote occurred in Kao Teluk District, North Halmahera.
"The Respondent (KPU) is suspected of having deliberately lost the petitioner's voice, namely candidate number three on behalf of Clara Pureng on the Regency Result D form," he said.
Based on the D Regency Results form owned by the KPU, he continued, PKB's vote acquisition was 2,091 votes. Meanwhile, according to his party, based on the C form, Plano Results and C forms, Copys and D forms of District Results, PKB votes amounted to 2,092 votes.

He said the loss of one PKB vote occurred at TPS 02 Dum-Dum Village, Kao Teluk District. Clara Pureng, who initially received one vote at the TPS, decreased to zero votes.
"So it is detrimental to the Petitioner by losing the votes acquired seat that the Petitioner should get at the North Halmahera Regency DPRD," he said.
PKB has also conveyed the lack of votes to the northern Halmahera Bawaslu with evidence Number 014/LP/PL/Regency/32.07/III/2024 dated March 21, 2024 and Bawaslu recommended re-voting to the North Halmahera KPU.
The petition stated that without sufficient reason, the KPU did not carry out the recommendation because there was not enough time to carry out the re-voting.
Based on this description, PKB asked the Constitutional Court to impose a decision to cancel KPU Decree Number 360 of 2024 concerning the determination of the results of the General Election of the Regency/City DPRD in the 2024 General Election along the results of the general election of the North Halmahera DPRD in Dapil 3 which includes Malifut District, Kao District, North Kao District, West Kao District, and Kao Teluk District.
PKB also asked the KPU to restore the votes of its party which had been removed and determined the correct vote acquisition according to their calculations, which was 2,092 votes.
