AMIN Couple's Expert Witness Calls Gibran's Candidate Is Not Valid

Vice President Gibran Rakabuming Raka for the 2024 Presidential Election (VOI) debate

JAKARTA - An administrative law expert from the Islamic University of Indonesia (UII) Yogyakarta, Ridwan, is one of the experts presented by Anies Baswedan-Muhaimin Iskandar's team in the 2024 presidential election dispute trial at the Constitutional Court (MK).

In the trial, Ridwan said that the nomination of Gibran Rakabuming Raka as a vice presidential candidate (cawapres) determined by the KPU was invalid.

"Gibran Rakabuming Raka's candidacy in the perspective of administrative law, I conclude it is invalid," said Ridwan at the Constitutional Court building, Monday, April 1.

Gibran was able to qualify as a vice presidential candidate thanks to the Constitutional Court's decision number 90/PUU-XXI/2023 which was read out on October 16, 2023. Gibran also registered as a presidential-cawapres candidate pair with Prabowo Subianto on October 25.

Meanwhile, during the registration period, the KPU has not changed KPU Regulation (PKPU) Number 19 of 2023 of the Nomination of Participants in the General Election of the President and Vice President.

So, according to Ridwan, even though the Election Law has been amended by the Constitutional Court, the rules regarding the age limit for presidential and vice-presidential candidates still apply to the old provisions because the PKPU has not been changed.

"The regulation that took effect at that time was KPU Regulation Number 19 of 2023 which requires the candidate to be at least 40 years old," said Ridwan.

"Only then did the registration be accepted, only then did the determination as a candidate pair use KPU's decision No. 1362 of 2023," he continued.

For information, the presidential election dispute lawsuit filed by Anies and Muhaimin as applicants has case number 2/PHPU.PRES-XXII/2024.

In the lawsuit, the applicant wants a re-vote by disqualifying Gibran Rakabuming Raka from the vice presidential candidate Prabowo Subianto.

Meanwhile, candidate pair number 3 Ganjar Pranowo-Mahfud MD in his petitum asked the Constitutional Court to instruct the KPU to re-vote by disqualifying Prabowo-Gibran.
