MKMK Affirms Anwar Usman Is Prohibited From Participating In The 2024 Election Dispute Trial

The Honorary Council of the Constitutional Court (MKMK) reiterated that Judge Anwar Usman could not be involved in adjudicating the 2024 General Election dispute (Pemilu).

"In accordance with MKMK's Decision Number 2 he (Anwar Usman) cannot follow or hear the dispute over the Presidential Election or Dispute of General Election Results," said MKMK member Prof. Yuliandri in Padang as reported by ANTARA, Friday, March 8.

Referring to the decision of the MKMK Anwar, who is a former Chief Justice of the Constitutional Court, is not allowed to participate in the trial of the 2024 General Election dispute even though he is listed as an active judge.

Meanwhile, for Judge Arsul Sani, Prof. Yuliandri said he was committed not to be involved in a legislative election dispute related to the United Development Party (PPP).

However, the former Chancellor of Andalas University said that Arsul Sani's certainty in dealing with election disputes depended on the judge's deliberation meeting (RPH).

Technically, the election dispute trial will take place with a panel mechanism. If Arsul Sani is not involved, it will automatically affect the division of performance or decisions.

"But I am sure that RPH will be wise in making this decision," he said.

Meanwhile, Chief Justice of the Constitutional Court Suhartoyo said the institution he led immediately discussed the certainty of the involvement of Judge Arsul Sani in the PHPU or the 2024 election dispute.

Suhartoyo emphasized that if Judge Arsul Sani was later decided not to be involved in dealing with election disputes, it would not be a significant problem. Because, based on the law on case handling, at least seven judges were carried out and a maximum of nine judges.

"Seven judges are still in the quorum but don't think about it first because the objection has not necessarily been granted," he said.
