Mahfud MD Calls The DKPP Decision A Moral Punishment For Gibran

JAKARTA - Vice Presidential Candidate number 3, Mahfud MD answered the question of the continuation of the decision of the Election Organizing Honorary Council (DKPP) regarding the violation of KPU ethics regarding the nomination of Gibran Rakabuming Raka as vice president of the 2024 presidential election.

"Regarding the DKPP decision, when there is a violation by the KPU, can Gibran be disqualified, even though we see that ethics has been violated many times?" asked one of the participants of the event entitled 'Tabrak Prof!' with Mahfud MD at the Bloc Post, Central Jakarta (Jakpus), Wednesday 7 February.

Responding to the statement, Mahfud Md also firmly said that the decision of the Constitutional Court (MK) regarding Gibran had officially become a vice presidential candidate and was final.

"The legalally written Gibran case has been completed, that he is legally a candidate, according to the law, it reads like that, the decision of the Constitutional Court (MK) which has been decided which has been in effect since the date of stipulation," said Mahfud.

The DKPP sentence, said Mahfud, was an administrative sanction, the chairman of the General Elections Commission (KPU) in this case was proven to have violated ethics and could be dismissed, but could not disqualify Gibran from the vice presidential candidate.

However, there are moral sanctions inherent in the DKPP decision which states that the Chairman of the KPU Hasyim Asy'ari and a number of KPU members have committed ethical violations by accepting Gibran's candidacy for vice president of the 2024 presidential election.

"Formal law does not win, but if everyone says 'hei this is an illicit child of the constitution', that's a social punishment, moral punishment in society. 'hei, because of Uncle's help, 'hei, because this is legal engineering', this will never be erased in its entire life," he said.
