Bringing Drugs To Bali, Romanian Citizen Sentenced To 10 Months In Prison

DENPASAR - Denpasar District Court Judge, Bali, sentenced a foreign national from Romania to 10 months in prison, namely the defendant Cosmin Liviu Opera (36), in a marijuana case.

Chairman of the Panel of Judges Agus Akhyudi in a hearing at the Denpasar District Court, Thursday (25/1) stated that the defendant Cosmin Liviu Opera was legally and convincingly proven guilty of possessing, storing and controlling narcotics.

"The trial sentenced the defendant Cosmin Liviu Oprea to 10 months in prison and a fine of Rp. 800 million," said Chief Justice Agus Akhyudi as quoted by ANTARA.

The defendant was found guilty of violating Article 111 paragraph 1 of the Law of the Republic of Indonesia Number 35 of 2009 concerning narcotics.

The verdict is much lower than the demands of the Public Prosecutor.

The prosecutor charged the defendant Cosmin Liviu Oprea, the man who works as a marketing officer for 5 (five) years in prison and a fine of Rp. 800 million, a subsidiary of 6 months because he was caught possessing marijuana-type drugs weighing 2.87 grams.

In the previous indictment, the defendant's prosecutor Cosmin Liviu Opera arrived at the International arrival terminal of I Gusti Ngurah Rai Airport on Friday 29/9/2023 using a Qatar Airways plane from Romania.

After arriving at the International Terminal of I Gusti Ngurah Rai Airport, the defendant filled out the Customs Declaration (BC 22) form and in the filling column knowing the luggage of narcotics by the defendant did not write on the custom declaration (BC 22) form that the defendant brought narcotics into the customs area of the Republic of Indonesia.

Furthermore, officers from Customs and Excise carried out an inspection which was a permanent procedure for passengers who had just arrived at the Customs and Excise checkpoint.

Customs and Excise officers at the international arrival terminal saw suspicious behavior from the defendant Cosmin Liviu Opera, so that the Customs and Excise officers immediately took the defendant and his luggage to the Customs and Excise examination room at the International Arrival Terminal of I Gusti Ngurah Rai Airport.

Then the Customs and Excise officer examined the defendant and the defendant's belongings in the form of a gray back bag from the Underarmour brand.

After opening, it contains white hattohlenes warma Carmen brands containing a pink plastic packaging containing a lump of brown brown green leaves containing class I narcotics preparations in the form of Delta 9 Tetrahydrocannabinol (Kode A) with a net weight of 2.70 grams net.

In addition, there is agrinder that reads The Bamur Amsterdam which contains brown brown leaves that are suspected of containing class I narcotics preparations in the form of Delta 9 Tetrahydrocannabinol (Code B) with a net weight of 0.17 grams net so that the total weight is 2.87 grams net.

Furthermore, officers from Customs and Excise at I Gusti Ngurah Rai International Airport immediately contacted the Bali Police Narcotics Investigation Directorate to follow up and secure the defendant Cosmin Liviu Opera.

In addition, Bali Police drug unit officers also confiscated a custom declaration (BC 22) on behalf of Cosmin Liviu Opera, boarding pass on behalf of Cosmin Liviu Oprea and a Samsung brand smartphone.

After being asked about ownership of all these items, the tardakwa Cosmin Liviu Opera stated that it belonged to the defendant, where the defendant obtained it from someone for free for the defendant to use when the defendant was watching a rock song festival in Romania on Monday, September 25, 2023, before the defendant left for Bali, Indonesia.
