The Corruption Case Of The Iron Sand Mine, The Former Head Of The NTB ESDM Office, Was Sued For 9 Years

The public prosecutor demanded that the Panel of Judges at the Corruption Court at the Mataram District Court sentenced the former Head of the West Nusa Tenggara Energy and Mineral Resources (ESDM), Muhammad Husni, who was accused of corruption in the iron sand mine in the Dedalpak Block.

"With this, we demand that the panel of judges impose a sentence on the defendant Muhammad Husni with a prison sentence of 9 years," said Dian Purnama representing the public prosecutor's team when reading the material on the defendant's demands before the Corruption Court Judge at the Mataram District Court, reported by ANTARA, Monday, January 15.

In the material of the prosecution, the Prosecutor also requested that the panel of judges impose a fine of Rp. 500 million, subsidiary to 6 months in prison.

The prosecutor set such a charge by stating that the defendant participated in committing a criminal act of corruption together related to the activities of PT Anugrah Mitra Graha (AMG) carrying out iron sand mining in the Dedalpak Block for the period 2021 to 2022 without obtaining a letter of approval for the planned budget activity (RKAB) from the Ministry of Energy and Mineral Resources.

The prosecutor asked the panel of judges to declare that the defendant's actions, who served as the Head of the NTB ESDM for the 2013 to August 2021 period, violated Article 2 paragraph (1) in conjunction with Article 18 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law no. 20 of 2001 jo. Article 55 paragraph (1) 1 of the Criminal Code in accordance with the first indictment of the public prosecutor.

"He asked the panel of judges to determine that the defendant remains in custody," he said.

The return of Rp800 million from the other defendants, namely Po Suwandi, at the investigation stage, was asked by the prosecutor to be confiscated by the state and taken into account as part of the reduction in the burden of replacement money that had been previously charged to the defendant Po Suwandi.

Prosecutors in reading out demands, outlining considerations in determining such demands.

"That the defendant did not support the government's program in eradicating corruption and the defendant admitted his actions," said the prosecutor.
