The Election Law Is The Most Tested At The Constitutional Court Throughout 2023 Followed By The Job Creation Law

JAKARTA - Chairman of the Constitutional Court (MK) Suhartoyo said Law Number 7 of 2017 concerning General Elections (UU Pemilu) became the law most tested in the Constitutional Court throughout 2023, 42 times.

"The law most frequently requested for testing is Law Number 7 of 2017 concerning General Elections, tested 42 times," Suhartoyo said during the Special Plenary Session for Submission of Annual Reports 2023 and Opening of Session Period 2024 reported by ANTARA, Wednesday, January 10.

Then, the next Law Number 11 of 2020 concerning Job Creation was tested 11 times, Law Number 8 of 1981 concerning the Criminal Procedure Law was tested seven times, and Law Number 1 of 2023 concerning the Criminal Code which was tested six times.

"With regard to the number of laws tested in 2023, as many as 65 laws are requested to be tested by the Constitutional Court," continued Suhartoyo.

The Chief Justice of the Constitutional Court also explained that throughout 2023, the Constitutional Court received 202 cases of law testing; the details are 19 cases registered in 2022 and 183 cases in 2023.

Of the 202 cases, 136 cases have been decided, consisting of 19 cases registered in 2022 and 117 cases registered in 2023.

There were 136 Constitutional Court decisions throughout 2023 consisting of 13 decisions with amar granted, 57 decisions rejected, 41 decisions unacceptable, and 25 cases withdrawn by the applicant.

"In 2023, the Constitutional Court will handle cases of judicial review of the law alone, no other cases will be filed," said Suhartoyo.

If withdrawn, the total number of cases registered from the Constitutional Court was formed in 2003 to December 2023, reaching 3,631 cases; of which 3,580 cases have been decided, while 51 other cases are still in the process of being investigated.

"Of the 3,580 cases that have been decided, consisting of 1,739 cases of law testing, 1,136 cases of dispute over the results of regional head elections, 676 cases of dispute over the results of general elections and presidential/vice-presidential elections, and 29 decisions of disputes over State Institutional Authority cases," Suhartoyo said.
