PDIP Asks Bawaslu To Make Sure Gibran Is Sanctioned By The DKI Provincial Government For Distributing Milk In CFD

JAKARTA - Secretary of the PDIP faction of the DKI Jakarta DPRD Dwi Rio Sambodo asked the Election Supervisory Agency (Bawaslu) to ensure the imposition of sanctions by the DKI Jakarta Provincial Government to the cawapres number 2 Gibran Rakabuming Raka in the case of distributing milk in the Sudirman-Thamrin car free day (CFD) area.

According to Rio, Bawaslu should coordinate with the DKI Provincial Government to follow up on the Bawaslu decision which stipulates that Gibran does not violate election provisions, but rather violates DKI Governor Regulation (Pergub) Number 12 of 2016 concerning the Implementation of Motor Vehicle Free Day (HBKB).

"Bawaslu should integrate with the local government to immediately make its decision because during a campaign like this, it feels like the leading sector is in Bawaslu," Rio said in his statement, Friday, January 5.

Rio gave an example of Bawaslu's position in handling reporting. When there were reports of the destruction of APK campaign props to the police, the police submitted the report to Bawaslu.

"For tracing cases like this, Bawaslu should be independent and not be influenced by pressure from any party, so that it can give birth to public trust in carrying out its supervisory duties," he explained.

Central Jakarta Bawaslu has decided that the activities of the vice presidential candidate number 2, Gibran Rakabuming Raka, which distributes milk in the Sudirman-Thamrin CFD area, do not fulfill the elements of election violations.

However, Gibran was declared to have violated another rule, namely DKI Governor Regulation (Pergub) Number 12 of 2016 concerning the Implementation of Motor Vehicle Free Day (HBKB). Then, what sanctions can be imposed on Gibran who distributes one of his campaign products at CFD?

Referring to Article 7 paragraph (2) of the Governor Regulation 12 of 2016, it is stated that the HBKB or CFD should not be used for the benefit of political parties and SARA as well as incitement speeches.

Then, Article 9 paragraph (2) letter e states that HBKB participants who violate the provisions in filling out the HBKB implementation event, the HBKB organizers will give a warning letter.

Article 9 paragraph (2) letter f states that if the HBKB participant who has been sanctioned by the reprimand repeats his actions, then the person concerned is no longer allowed to fill the activities in the implementation of the next HBKB.

Thus, if the DKI Jakarta Provincial Government imposes sanctions on Gibran due to the incident at CFD Sudirman-Thamrin last December 3, the eldest son of President Joko Widodo will only receive a written warning.

The Central Jakarta Bawaslu decision came out on January 3 evening, after summoning Gibran to be clarified during the day.

"Recommends findings with registration number 001/Reg/TM/PP/City/12.01/XII/2023 regarding the distribution of milk (Greenfields) by Gibran Rakabuming Raka to residents who are in the car free day area of Central Jakarta on December 3, 2023 which was registered on December 11, 2023 as another violation of the law," said Head of Central Jakarta Bawaslu Christian Nelson Pangkey or Sonny in his statement.
