Medan District Court Judge Sentenced Former BRI Mantri In Asahan 5 Years In Prison

The panel of judges at the District Court (PN) of North Sumatra (North Sumatra) sentenced Juan Irwan Parningotan, a former BRI man in Asahan Regency, to five years in prison in a corruption case.

"In addition, the defendant was fined Rp250 million, subsidiary to three months in prison," said Chief Judge M Nazir at the Medan District Court, quoted by ANTARA, Monday, October 23.

The panel of judges believes that the defendant has fulfilled the criminal element of Article 2 Paragraph (1) in conjunction with Article 18 of Law (UU) Number 31 of 1999 has been amended by Law Number 20 of 2021 concerning the eradication of criminal acts of corruption.

Namely, said Nasir, without the right to enrich oneself or other people or corporations which resulted in state financial losses of Rp. 634,680,000.

The funds come from manipulating customer data as if they are entitled to a micro people's business credit (KUR) which is detrimental to state finances at the BRI Bandar Pasir Mandoge Unit, Kota Kisaran Branch Office and BRI Terminal II Unit in Kisaran City, Asahan Regency.

Therefore, said Nazir, the panel of judges also gave an additional penalty of paying replacement money (UP), namely Rp. 634,680,000

"With the provisions, after legal force, property will be auctioned off by the prosecutor, if it has not been covered, it will be replaced with 1.5 years imprisonment," he said.

The panel of judges said that the aggravating thing for the defendant's actions was not in line with the government's program in eradicating corruption, while the mitigating factors for the defendant were never punished, regretted and admitted his actions.

The panel of judges gave the prosecutor seven days, the defendant or the defendant's legal adviser thought to accept or appeal the decision.

The judge's decision was lighter than the demands of the Prosecutor's Office, Asahan Harold Manurung, for seven years and a fine of Rp. 250 million and three months in prison, and UP Rp. 833,991,645.
