Chaotic Land Dispute In Kosambi Tangerang: Banten High Court Wins Defendant As Sah Owner

JAKARTA The chaotic land dispute in Salembaran Jaya Village, Kosambi, Tangerang Regency has come to light. The panel of judges at the Banten High Court in the case Number 205/PDT/2022/PT.BTN on September 6, 2022 declared Ahmad Ghozali the winner and is the owner of the approximately 2 hectare land.

The decision of the High Court was the answer to the legal action filed by TP in case number 785/Pdt,G/2021/PN.TNG. The lawsuit stated that TP was the victim of the land grab on Jalan Salembaran Jaya. However, in the trial process, the panel of judges won the defendant Ahmad Gozali as the legal owner.

"Tonny Permana is declared to have no more rights and interests on land covering an area of approximately 20,000 M2 or 2 hectares. Randy considered the TP as a victim in the matter of land ownership. In fact, Randy continued, it was very clear that the basis for TP land ownership was illegal, not true and the court should have canceled it.

As a reinforcement in this case, Randy said, the criminal report submitted by TP against his client was not fully running and the examination process alias SP3 was stopped, because it was absolutely not proven that Ahmad Ghozali had committed a crime.

"On the other hand, the report submitted by Ahmad Ghozali against Tonny Permana for alleged forgery of letters and fraud based on the police report number LP/B/6326/XII/2021/SPKT/Polda Metro Jaya has been running, and the status of the case has now been upgraded to the investigation stage," he said.

"That at this time our report process has been raised to the investigation stage and a case title will be carried out immediately because of course the Polda Metro Jaya investigators have found a strong enough criminal element based on the examination of evidence and witnesses," he added.

It is known that the Police Report (LP) made by Ahmad Ghozali began with TP statements and documents that Randy said were invalid and no longer valid. But Randy considers the document to be used continuously as material for the lawsuit against Ahmad Ghozali.
