Lawyer Lukas Enembe Claims Law Immunity Advocates, KPK: Reasons To Avoid Criminal Process

JAKARTA - The Corruption Eradication Commission (KPK) said an advocate must still use the rules when defending his client. They should not arbitrarily advise against litigants according to the Constitutional Court Decision Number 26/PUU-XI/2013 as well as Number 7/PUU-XVI/2018. This was conveyed by the Head of the KPK News Section Ali Fikri in response to the statement of the lawyer for the inactive Papua Governor Lukas Enembe, Stefanus Roy Rening that his profession has the right to immunity. "It is firm to consider that advocates in their professional life are not only in good faith but also must not be contrary to the laws and regulations," Ali told reporters, Tuesday, May 9. Ali called a lawyer carelessly in defending his client, then the immunity rights they have lost. After all, none of these professions have immunity to legal proceedings in the event of a violation of the law. "In a state of law, everyone has the same position before the law so that in principle no single professional is above the law, including the advocate profession," he stressed. In addition, the KPK also had strong evidence before establishing Roy as a suspect in the alleged obstruction of bribery, gratuities, and money laundering (TPPU) investigations that ensnared Lukas Enembe. "All of these proceedings of the case are in accordance with legal procedures," said Ali. Previously reported, Lukas Enembe's lawyer, Stefanus Roy Rening fulfills the summons of the Corruption Eradication Commission (KPK) as a suspect in the alleged investigation. It's just that, he assessed that the application of Article 21 of the Corruption Law should not be carried out.

"KPK must also know that there are lex specialists of the Advocate Law," Roy told reporters at the KPK's Red and White Building, Kuningan Persada, South Jakarta, Tuesday, May 9. Roy said that Article 21 of the Anti-Corruption Law states that anyone who thwarts or obstructs investigations can be punished. However, this rule cannot be used to ensnare advocates like himself who are protected by Article 16 of the Advocate Law.
