3 Fill In Komnas HAM Recommendations In The Brigadier J Case, This Is Police Response

YOGYAKARTA - Komnas HAM's letter of recommendation for the murder case of Brigadier J has been given to the Police. The recommendations are the result of an investigation conducted by Komnas Ham so far.

Komnas HAM made two recommendation reports in the investigation into the murder case of Brigadier J, namely complete reports and technical reports. A complete or comprehensive report will be submitted to President Jokowi and the Indonesian House of Representatives. Meanwhile, the technical report given today to Komnas HAM.

The chairman of Komnas HAM, Ahmad Taufik Damanik, said that in the Komnas Ham recommendation letter it was conveyed regarding the obstruction of justice, as well as extrajudicial killings. Komnas Ham recommends the steps of the Police in handling similar cases.

"That's precisely the main thing (obstruction of justice), because that is the issue of human rights. If justice obstruction cannot be overcome, justice for victims will not be obtained," said Ahmad Taufan Damanik, Thursday, September 1.

Komnas HAM gave a recommendation to the National Police Special Team in giving the murder case of Brigadier J. Komjen Agung Budi Maryoto, Irwasum Polri, received three recommendations from Komnas HAM.

Komnas Ham discusses extraordinary killing in a letter of recommendation given to the Police. Extrajudicial killing is a violation of a person's right to life, which is an act in any form that causes a person to lose his life without going through a legal process and a court decision.

"There are three substances, which are recommended by Komnas HAM. The first is for the case itself, a murder case. The police are known as Article 340, if at Komnas HAM it is extraordinary killing," said Komjen Agung Budi Maryoto as the Head of the National Police Special Team at a press conference, Thursday (1/9).

The contents of the second Komnas HAM recommendation letter were the absence of considerations. Komnas HAM concluded that the actions that had been alleged to exist so far did not exist.

"The second is Komnas HAM's recommendation, which concludes that there is no crime of violence or opinion," said Komjen Agung Budi Maryoto.

The third content of the Komnas HAM recommendation letter is the obstacle to justice. Obstruction of Justice is all actions to restrain, influence, threaten, which hinder a legal process in a case.

The rules regarding the obstacles to justice are contained in Article 21 of Law Number 31 of 1999 jo. Law Number 20 of 2001 concerning the Eradication of Criminal Acts of Corruption (UU Corruption), as well as Article 221 of the Criminal Code (KUHP).

In handling this case, the parties who committed the crime have been named as suspects and detained. Komjen Agung also said that this crime is also being handled by Timsus.

"The third is from the murder of the murder, there is a crime or crime of obstruction of justice. Coincidentally, Timsus investigators are taking steps to deal with the criminal act of obstruction of justice," he explained.
