NTB Police Immediately Submit Files Of Ustaz Mizan Suspect Of Hate Speech To Prosecutors

MATARAM - The Cyber Investigator of the Special Criminal Investigation Directorate (Ditreskrimsus) of the West Nusa Tenggara Regional Police (Polda NTB) has scheduled the transfer of files for Ustaz Mizan Qudsiah, a suspect in hate speech to the prosecutor's office.

The Head of Public Relations of the NTB Police, Kombes Artanto, said that the delegation agenda followed his case, which is currently under investigation by prosecutors.

"We plan to immediately transfer it to the Public Prosecutor, but it is still waiting for the file to be declared complete by the prosecutor," said Artanto, quoted by Antara, Wednesday, February 9.

He said there were no obstacles in the filing process by investigators. But only the need for completeness of evidence that needs to be strengthened.

Regarding the presence of the As-Sunnah Islamic Boarding School lecturer in Bagek Nyake, East Lombok Regency, it is confirmed that Artanto is still under police supervision.

"Indeed, until now there has been no detention, but we guarantee that the person concerned is still under our supervision and security from the police," he said.

In this case, Ustaz Mizan is accused of Article 14 paragraph 1, 2 and Article 15 of Law No. 1/1946 regarding Criminal Law Regulations and/or Article 28 paragraph 2 in conjunction with Article 45 paragraph 2 of Law No. 19/2016 concerning Amendments to Law No. RI Law Number 11/2008 concerning Information and Electronic Transactions.

Article 14 of Law Number 1/1946 concerning Criminal Law Regulations regulates the issue of spreading false news that can cause trouble in the community. The maximum penalty is 10 years in prison as regulated in paragraph 1.

Then Article 28 paragraph 2 of the RI Law Number 19/2016 concerning Amendments to the RI Law Number 11/2008 concerning Electronic Information and Transactions regulates hate speech that causes hatred or hostility to certain individuals and/or community groups based on ethnicity. , religion, race, and intergroup (SARA).

Ustaz Mizan previously in the video clip of his 19-second lecture, there were remarks that allegedly discredited the sacred tombs of the ancestors on the island of Lombok.

He was also reported by community groups regarding alleged violations of the Information and Electronic Transactions Law to the NTB Regional Police.
