President Jokowi's Complete Statement Commenting On The Constitutional Court's Decision On The Job Creation Act

JAKARTA - President Jokowi respects the decision of the Constitutional Court which has already been knocked down if the Employment Creation Law (omnibus law) is unconstitutional. Even though the decision has been made, Jokowi ensures that the agenda for structural reform, deregulation, and debureaucratization will continue.

"I will continue to lead and ensure legal certainty and government support for ease of investment and business," said President Jokowi, Monday, November 29.

This was conveyed by Jokowi as a follow-up to the Constitutional Court's Formal Examination Decision on the Job Creation Act.

The Constitutional Court has decided that the job creation law is unconstitutional because it is formally flawed because in the discussion process it is not in accordance with the rules and does not meet the element of openness. The constitutional judges agreed that the method of merging or the omnibus law in the Job Creation Act was not clear whether it was the making of a new law or a revision.

In addition, this law is considered not to hold the principle of openness to the public even though it has held several meetings with several parties in the process of its formation.

Assalamu'alaikum warahmatullahi wabarakatuh, Good afternoon, Peace be upon us all.

Ladies and gentlemen, the government's commitment and my commitment to the agenda of structural reform, deregulation, and debureaucratization will continue to be implemented. Legal certainty and government support for ease of investment and doing business, I will continue to lead and I will ensure.

As a democratic country based on law, the government respects and immediately implements the Decision of the Constitutional Court (MK) Number 91/PUU-XVIII/2020.

I have ordered the Coordinating Ministers and related ministers to immediately follow up on the Constitutional Court's decision as soon as possible. And the Constitutional Court has stated that the Job Creation Act is still in effect.

The government and the DPR as the legislators are given a maximum of two years to make revisions or improvements. Thus, all implementing regulations for the existing Job Creation Law are still in effect.

By stating that the Copyright Act is still valid by the Constitutional Court, then all material and substance in the Job Creation Act and the full rules remain valid without any article being canceled or declared invalid by the Constitutional Court.

Therefore, I assure business actors and investors from within and outside the country that the investments that have been made, as well as investments that are and will be in progress, are safe and secure.

Once again, I make sure that the government guarantees the security and certainty of investment in Indonesia.
