Perpetrators Affected By Stroke, The Holy Prosecutor's Office Uses Restorative Justice In The Beating Case Of Graha Mandiri Employees

KUDUS - The Kudus District Prosecutor's Office, Central Java, has implemented restorative justice in the case of violence with the perpetrator of a customer against an employee of the Graha Mandiri Kudus Savings and Loans Cooperative (KSP) who wanted to collect loan arrears.

"The case was dismissed because the suspect had a stroke as evidenced by the results of the hospital doctor's examination," said the Head of the General Crimes Section of the Kudus District Attorney Muhammad Baharuddin in Kudus, Antara, Wednesday, November 17.

During this year, the perpetrators were also assisted with temporary housing (rented) as well as living expenses because the house had been auctioned off to pay off a loan worth Rp250 million.

Based on the results of the hospital doctor's statement, he said, the suspect named Imam Sayogo, a resident of Getaspejaten Village, Jati District, who is also a customer of KSP Graha Mandiri experienced two stroke symptoms.

In this case, the victim is named Budi Kariawan as Deputy Manager of the Graha Mandiri KSP Cooperative. This case began when the victim wanted to collect a loan that was in arrears by visiting the perpetrator's house in 2018.

After an argument with the perpetrator's wife, the perpetrator appeared and brought a sharp weapon, then injured the victim. This case was reported to the police.

Because after the incident the perpetrator suffered two strokes, he said, a decision was made to make peace with restorative justice or settle cases outside the trial.

To make peace, his party summoned suspects, victims, and investigators for peace. At first, the suspect refused to make peace but eventually gave in. Evidence of peace is made through minutes of peace by both parties witnessed by the investigator, the victim's lawyer, and the head of the RT where the suspect lives.

After going through peace, correspondence in stages to the Central Java Prosecutor's Office, then forwarded to the Attorney General's Office for case exposure.

On November 16, 2021, a decision was sent to approve the issuance of a decision on the termination of prosecution (SKP2).

The Attorney General's Office approved the proposal of the Holy Prosecutor's Office to carry out restorative justice, until finally 15 November 2021, the Holy Prosecutor's Office issued a termination of prosecution on behalf of the Imam Suyogo case that violated Article 351 paragraph (2) or paragraph (1) of the Criminal Code.

The Deputy Manager of the KSP Graha Mandiri Cooperative, Budi Kariawan, admitted that the visit to his customer's house was in order to find a solution so that the loan could be paid off.

The peace effort was also welcomed because from the start he had no other intention than to find a solution so that his customers' arrears were paid off.
